A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN FOR MOON VALLEY, TRACT 4120, BEING A
SUBDIVISION OF A PORTION OF THE NEY< OF THE SWv. OF SECTION 25, TOWNSHIP 19
NORTH, RANGE 22 WEST, IN THE SOUTH MORAVE VALLEY AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
3,1997, a public hearing was conducted to determine whether approval should be granted for an Extension
of Time as requested by Delmar 1. Tilton of Sun Ventures, owner, for the above described Preliminary
Subdivision Plan. The new engineer of record is Mohave Engineering, Kingman, Arizona, and
WHEREAS, the subdivision is located approximately three miles south of Bullhead City. The site
is accessed via State Highway 95, then east one mile on Joy Lane, then north one-half mile on Mountain
View Road, then east approximately one-half mile, and south through other unrecorded developments to the
site, and
WHEREAS, the Preliminary Plan depicts 5 acres subdivided into 16 single-family residential lots,
ranging in size from 9,800 to 12,375 square feet, and
WHEREAS, the developer has indicated in a letter dated November 20, 1996, that an Extension of
Time is being requested based on the following: "This extension is requested because our subdivision Moon
Valley, was submitted in conjunction with two other plats, Moon Ridge and Sun Desert Estates. Moon
Valley is located south of Sun Desert Estates, and is awaiting development of Sun Desert to provide access
to the utilities as well as roads. It is our intention to develop Moon Valley as soon as paved access and the
utilities are available. I have been advised that the present owner of Sun Desert Estates is negotiating for
a sale which hopefully will lead to its early development", and
WHEREAS, the Preliminary Plan was approved by the Mohave County Board of Supervisors on
March 4,1991, per BaS Resolution No. 91-63. The Final Plat was approved on December 16, 1991, per
BaS Resolution No. 91-337. The first and second Extensions of Time for the Preliminary Plan were
approved on January 3, 1995, per BaS Resolution No. 95-2. The third extension was approved on January
2,1996, per BaS Resolution No. 96-10. Subdivision Regulation Article 3.10-1 states: "Upon application
to the Commission and prior to the expiration of the time limit, extensions in increments of one (I) year may
be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action
is not taken then all proceedings relating to the plat shall be terminated", and

WHEREAS, the Mohave County Public Works Department has stated that continued adherence to
BaS Resolution Nos. 91-63 and 91-337, which approved the Preliminary Plan and Final Plat, is required.
Public Works also stated that the last Extension of Time required an updated cost estimate, and that none
had been received, and
WHEREAS, this will be the fourth Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
designated as an Urban Development Area.
c. The site is adequate for the action intended and the proposal is consistent with the
surrounding land uses.
d. This request does not comply with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 8, 1997, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions of BaS Resolution Nos. 91-63, 91-337, 95-2, and 96-10.
2. The neighboring proposed subdivisions upon which the recordation of Moon Valley, Tract
4120, is dependent must be recorded, or the access, utility and drainage improvements to the
Moon Valley site may be arranged for separately and submitted prior to the recordation of
the Moon Valley Final Plat. Unless significant progress is made in the coming year toward
the recordation of this project, Planning staff will recommend denial of any additional
Extensions of Time for this Preliminary Plan.
3. Any future submittal for processing of this subdivision shall include a current revised

engmeer s cost estimate.
4. This Extension of Time will be in effect until December 16,1997.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, January 18, 1997, and posted on January 17, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and

WHEREAS, during the Board's meeting, the applicant, Mr. Tilton, explained the difficulty of
complying with conditions 2 and 3 of the Planning and Zoning Commission's recommendation.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting
on Monday, February 3,1997, APPROVED this Extension ofTime as recommended by the Mohave County
Planning and Zoning Commission with conditions 2 and 3 amended as follows:
