A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN FOR MESA VISTA, TRACT 4117, BEING A
SUBDIVISION OF A PORTION OF THE WJf, OF THE SWv. OF SECTION 24, TOWNSHIP 19
NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE V ALLEY AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February
3, 1997, a public hearing was conducted to determine whether approval should be granted for an Extension
of Time as requested by Robert C. Rossberg, of the Rossberg Family Trust, owner, for the above described
Preliminary Subdivision Plan, and
WHEREAS, the engineer of record is Tri-State Land Surveyors and Civil Engineers, La Quinta,
California. The project engineer is licensed in the State of Arizona, and
WHEREAS, the subdivision is located approximately two miles south of Bullhead City. The site
is accessed via State Highway 95, then east one mile on EI Rodeo Road, and
WHEREAS, the Preliminary Plan depicts 42 acres subdivided into 147 single-family residential lots,
and a 4-acre commercial parcel, and
WHEREAS, the engineer has indicated in a letter dated November 25, 1996, that an Extension of
Time is being requested based on the following: "We... need an extension to allow the FEMA issue to be
resolved, which in turn will allow the final plat and improvement plans to move forward", and
WHEREAS, the Preliminary Plan was approved by the Mohave County Board of Supervisors on
December 3, 1990, per BaS Resolution No. 90-349. The Final Plat was approved on April I, ] 991, per
BaS Resolution No. 91-110. The first and second Extensions of Time for the Preliminary Plan were
approved on February I, 1994, per BaS Resolution No. 94-39. The third extension was approved on
January 3, 1995, per BaS Resolution No. 95-3. The fourth extension was approved on March 7, 1996, per
BaS Resolution No. 96-78. A revised Preliminary Plan was submitted for review in May, 1996. The Public
Works Department stated that until a determination could be received from FEMA as to the likelihood of
flooding in the southern portion of the subdivision, the review could not be completed. The revised
Preliminary Plan has not been considered by the Planning and Zoning Commission and the Board of
Supervisors. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior
to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board of

Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all
proceedings relating to the plat shall be terminated", and
WHEREAS, in regard to this extension request, the Mohave County Public Works Department has
"No objections conditional to: Continued adherence to Resolutions 90-349 and 91-310 (sic [91-110
intended]) which approved the Preliminary Plan and Final Plat is required. Continue to address the
comments of Mr. Ganyo's (the former Mohave County Engineer) letter. In addition, this subdivision
incorporates a design for a portion of the EI Rodeo Flood Control Channel [of] which the County is working
with FEMA for a floodplain revision. Cooperation from the developer will need to be provided to ensure
that no adverse impact to the FEMA approval process will occur as a result of the development of this
subdivision", and
WHEREAS, this will be the fifth Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action complies with the Mohave County General Plan, and the property is
designated as an Urban Development Area.
c. The site is adequate for the action intended and the proposal is consistent with the
surrounding land uses.
d. This request does not comply with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
January 8, 1997, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions of BaS Resolution Nos. 90-349,91-110,94-39,95-3, and
96-78.
2. Unless significant progress is made in the coming year toward the recordation of this project,
Planning staff will recommend denial of any additional Extensions of Time for this
Preliminary Plan.
3. This Extension of Time will be in effect until December 3,1997.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, January 18, 1997, and posted on January 17, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting
on Monday, February 3, 1997, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
