NEll. NWy. OF SECTION 33, TOWNSHIP 41 NORTH, RANGE 15 WEST, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 3,1997, a public hearing was conducted to determine whether approval should be granted to Abandon the above described Ingress/Egress easement and cul-de-sac bulb as requested by the owner/developer of Beaver Dam Heights, James A. Martin of Mesquite, Nevada, being represented by Mohave Engineering Associates, Inc., Kingman, Arizona, and WHEREAS, this property is located west of County Highway 91 and north of Interstate 15, approximately one and one-half miles north of the Interstate 15/Littlefield Interchange in the LittlefieldlBeaver Dam area. The site is accessed directly west from County Highway 91 via Shirley Lane. The roadway easement lies approximately one-quarter mile south of Shirley Lane. The property is vacant, sloping to the southeast. The surrounding land uses consist of vacant BLM land to the north and east, a mobile home park to the east and a few single-family residences to the southwest. There are no significant drainage patterns, and WHEREAS, the applicant requests this Abandonment to allow for the property to be subdivided. The applicant proposes to divide the 19.294 acres into 77 lots and four parcels. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, the Rio Virgin Telephone & Cablevision Co. states the Company "has new facilities in the area and (the easement) cannot be abandoned," and WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. RESOLUTION NO. 97-29 Page 2 ~ . . PAGE 2 OF 2 6K 2852 PG 992 FEE~9706035 d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. The abandonment will not deny legal access to adjacent land owners. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on January 8, 1997, the Commission recommended APPROVAL for an Abandonment subject to the following: I. The approved Preliminary Plan for BEAVER DAM HEIGHTS, Tract 3506, shall incorporate existing telephone and cable television service in its plan so as not to interrupt existing service. 2. The Abandonment shall become effective with the recordation of the Final Plat for BEAVER DAM HEIGHTS, Tract 3506. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, January 18, 1997 and January 25, 1997, and posted January 17, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, February 3,1997, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
