OF SECTION 27, ON THE NW SIDE OF STATE HIGHWAY 66 BETWEEN RYAN AVENUE AND THOMPSON AVENUE, IN TOWNSHIP 22 NORTH, RANGE 16 WEST, FOR A SWAP MEET IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 6,1997, a public hearing was conducted to determine whether an Amendment to Resolution P&ZC: 87-191, setting forth a Zoning Use Permit, should be granted for the above described property as requested by Myram and Doris McJunkin of Kingman, Arizona, and WHEREAS, the language to be added has been bolded; language to be deleted has been stftlek, and WHEREAS, this property is located north of the city of Kingman, on the northwest side of State Highway 66 between Ryan Avenue and Thompson Avenue. The site is accessed from State Highway 66 via northwest on either Ryan Avenue or Thompson Avenue to the site. There is parking on both the northeast side and the southwest side of the swap meet located on this property. The surrounding land uses consist of vacant land to the northeast, southeast and southwest, and single family residences to the northwest. There are no significant drainage patterns, and WHEREAS, the applicants request this Amendment to Resolution P&ZC: 87-191, approving a Zoning Use Permit, to allow for permanent canopies, avmings and shade frames to be provided for their vendors. Also, the applicants request that the tables provided to traveling vendors be left on some of the vendor spaces (Condition No.8). The applicants request that storage units be provided to permanent local vendors so that they may leave their wares on site during the week (Condition No.8). In addition, the swap meet would like to allow overnight parking for traveling vendors for their recreational vehicles for up to 48 hours (Condition No.6). The county is concerned about the health and safety issues involved with the overnight parking of recreational vehicles and is currently developing standards for this. This item will be addressed when the county adopts these standards, and and WHEREAS, the Mohave County General Plan designates this area as an Urban Development Area, WHEREAS, a review ofFEMA FIRM Panel #040058-2170B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and . . PAGE 2 OF 3 BK 2841 PG 356 FEH9701178 RESOLUTION NO. 97-17 Page 2 WHEREAS, this item was first heard by the Planning and Zoning Commission on October 9, 1996 and was continued at the request of the applicant, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 11, 1996, the Commission recommended APPROVAL for the proposed Amendment to Resolution P&ZC: 87-191 setting forth a Zoning Use Permit subject to the following: I. If construction or use has not commenced within one (1) year of the Board of Supervisors approval of the Zoning Use Permit or if the use has been discontinued for six (6) months, then approval shall terminate at that date. 2. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors if, in the opinion of the Commission and the Board, the continued use of the property would be contrary to the public health, safety and welfare. 3. That a zoning (building) permit be obtained. 4. That adequate off-street visitor/vendor parking be provided on-site. 5. That sanitary facilities be provided as per State and/or County Health Department requirements, whichever is applicable. 6. There shall be no overnight parking of RVs, trailers or camping. 7. Operation of the swap meet shall be limited to the hours of7:00 a.m. to 8:00 p.m.; during the summer this activity may begin at 6:00 a.m. 8. Storage containers may be provided for permanent vendors so that they may leave their wares on site during the week. The site plan per Section 27.P (Site Plan Requirements) must be revised to show the location of each permanent container and approved prior to approval of permits. Sales cannot be conducted from the containers without complying with the Uniform Building Code (UBC) requirements. . . RESOLUTION NO. 97-17 PAGE 3 OF 3 BK 2841 PG 357 FEE;9701178 Page 3 9. A view obscuring screening shall be erected and installed along the north boundary of this site adjoining the residential lots in New Kingman Addition #6 as well as along the property adjoining the parcel where the rest home is located. 10. Permanent canopies, awnings and shade frames may be provided to vendors and must comply with the Uniform Building Code (UBe) requirements. 11. Due to the increase in use, the applicant has to provide a minimum 24-foot wide paved driveway from the edge of pavement to the property line, to include 30-foot radius curves, to protect the edge of the pavement for Thompson Avenue and Ryan Avenue. A right-of-way permit will have to be obtained from the Mohave County Public Works Department prior to working within the right-of-way (attention Bassam M. Elters, P.E., Assistant County Engineer). WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 21, 1996, and posted December 20, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 6, 1997, APPROVED this Amendment to Resolution P&ZC: 87-191 setting forth a Zoning Use Permit as recommended by the Mohave County Planning and Zoning Conunission and outlined herein.
