MDHAVE COUNTY RECORDE 01/U8/97 03:54P PAGE 1 DF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-16 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 1, BLOCK G, LAKE MOHA VE COUNTRY CLUB ESTATES, UNIT 3, AMENDED, IN SECTION 31, TOWNSHIP 22 NORTH, RANGE 16 WEST, FOR A CHURCH IN A C-2H (GENERAL COMMERCIAL HIGHWAY FRONT AGE) ZONE, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 6,1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by The United Pentecostal Church, being represented by the pastor, Reverend Jack Walker, Trustee, of Kingman, Arizona, and WHEREAS, this property is located east of Stockton Hill Road and south of Northern Avenue, north of the City of Kingman. The site is accessed from Stockton Hill Road via east on Northem Avenue to the site, located on the southwest comer of Northern Avenue and North Adams Street. The property is vacant and slopes slightly to the east The surrounding land uses consist of single family residences to the south and numerous commercial businesses to the east and west on both sides of Northern A venue. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a church in a commercial zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2165C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the City of Kingman recommends that a view-obscuring fence between the residential zoned properties and the church be constructed at the time of development, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. .. . . PAGE 2 OF 2 BK 2841 PG 354 FEE~9701177 RESOLUTION NO. 97-16 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 11, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. Thi$ Zoning Use Permit is for a church in a C-2H (General Commercial Highway Frontage) zone and activities related thereto. MOHA VE COUNTY BOARD OF SUPERVISORS 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. A Limited Drainage Report shall be submitted for the mitigation of any adverse impact to the adjacent property caused by any additional runoff created by this development. 3. The applicant shall build a view-obscuring fence between the residential zoned properties and the church, to be constructed at the time of development. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or ifthe use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 21, 1996, and posted December 20, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ~.d~~ Carol S.
