OF SECTION 5, TOWNSHIP 21 NORTH, RANGE 16 WEST, FOR A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE KINGMAN AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 6, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by Ken S. Henry and Patrice C. Ackerman of Kingman, Arizona, and WHEREAS, this property is located north of Airway Avenue between North Bank Street and Rainbow Drive, northwest of State Highway 66. The site is accessed from State Highway 66 via west on Airway Avenue to the site, located on the northeast comer of Airway Avenue and North Bank Street. The property is relatively flat, sloping slightly to the south. There is an existing automobile wash on the eastern portion of the property; the remainder of the property is vacant. The surrounding land uses consist of several businesses and vacant land. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a caretaker residence in conjunction with the automobile wash. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMl\ FIRJv! Panel #040058-2350C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 11, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 97-15 PAGE 2 OF 2 BK 2841 PG 352 FEE~9701176 Page 2 ... ..- ... . . I. This Zoning Use Permit is for a caretaker residence in conjunction with the automobile wash and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. The completed site plan for the automobile wash prepared and submitted in accordance with Section 27.P (Site Plan Requirements) must be amended and approved prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 21, 1996, and posted December 20, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 6, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
