WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 6,1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by H. Abraham Dehaybi of Kingman, Arizona, and WHEREAS, this property is located north of the City of Kingman and northwest of State Highway 66. The site is accessed from State Highway 66 via northwest on Shangri La Drive to Sunshine Drive, then northeast on Sunshine Drive to Prescott Street, then north on Prescott Street to the site, located on the east side approximately 400 feet north of Sunshine Drive. The property is vacant and relatively flat. The surrounding land uses consist of vacant land, several single-family residences and several commercial businesses along Sunshine Drive. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a cemetery as allowed by Mohave County Zoning Regulations, Section 27.A-2 (Special Uses). The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIR.l\1 Panel #040058-2350C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on November 13, 1996 and the Commission could not carry a recommendation to send to the Board of Supervisors. The Commission continued it to this meeting, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. - -" . . PAGE 2 OF 2 BK 2841 PG 350 FEE~9701175 RESOLUTION NO. 97-14 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December II, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: . 1. This Zoning Use Permit is for a cemetery as allowed by Mohave County Zoning Regulations, Section 27.A-2 (Special Uses), and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 21, 1996, and posted December 20, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 6,1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
