MOHAVE COUNTY RECORDEr 01/08/97 03:45P PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-6 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 1, BLOCK B, GOLDEN SHORES, UNIT 1, FIRST AMENDED, IN SECTION 15, TOWNSHIP 16 NORTH, RANGE 21 WEST, FOR A STORAGE FACILITY FOR WATER COMPANY VEHICLES AND SUPPLIES IN A R-l (SINGLE FAMILY RESIDENTIAL) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 6,1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by G. Kelly Grier, Burton Engineering, Inc., of Bullhead City, Arizona, representing the Golden Shores Water Company, an Arizona Corporation, of Topock, Arizona, and WHEREAS, this property is located south of County Route 1 and west of the Oatrnan-Topock Highway (Old US Highway 66) in the Golden Shores area. The site is accessed from County Route I via south on Golden Shores Parkway to Shore Drive, then west on Shore Drive to the site, located on the north side of Shore Parkway where it is joined by Shore Drive. The property has a vacant single family residence on it. The surrounding land uses consist of vacant lots and single family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for the water company to demolish the existing house and build a new structure with a residential design in order to blend with the character of the surrounding neighborhood. The water company will use this new structure for the storage of water company vehicles, supplies and a workshop for occasional use. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-2805 indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on November 13, 1996. Due to changes made by the applicant at the meeting and opposition from surrounding property owners, the applicant's representative requested that it be continued to the Commission's December II, 1996 meeting, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. . . RESOLUTION NO. 97-6 PAGE 2 OF:1 BK 2841 PG 329 FEH9701167 Page 2 c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. I. This Zoning Use Permit is for the water company to build a new structure to resemble a house for the storage of water company vehicles and supplies and activities related thereto. This Zoning Use Permit is not for a water tank. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 11, 1996, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 2. All water company vehicles and equipment shall be stored inside the structure. There shall not be any storage on the open portions of this lot. 3. The water company will build a new structure in order to blend with the character of the surrounding neighborhood and will meet all requirements for Mohave County Building Permits and setback requirements. In addition, there will be a six.foot concrete block fence constructed around the rear portion of this lot, except for points of access, which shall be gated for safety purposes with view-obscuring gates. 4. The Golden Shores Water Company shall provide additional landscaping in order to further ensure screening. The water company shall maintain the structure, the landscaping and block wall constructed on this lot. 5. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 6. The appropriate zoning, building, environmental and t100dplain permits will be obtained prior to construction. 7. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 8. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety and welfare. .. .'. . . PAGE 3 OF 3 BK 2841 PG 330 FEE~9701167 RESOLUTION NO. 97-6 Page 3 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 21, 1996, and posted December 20, 1996, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. MOHA VE COUNTY BOARD OF SUPERVISORS NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, January 6, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~d~dr~ Carol S.
