OF SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST AND A PORTION OF THE SEY.. OF SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, TO BE KNOWN AND SUBDIVIDED AS SUN VALLEY, TRACT 4064, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO R-O (SINGLE FAMILY RESIDENTIALIMOBlLE HOMES PROHIBITED) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by G. Kelly Grier, Burton Engineering, Inc., Bullhead City, Arizona, representing the owner, John McCormick, McCormick Development Corporation of Bullhead City, Arizona, and WHEREAS, this property is located south of Bullhead City, east of State Highway 95 between Lipan Boulevard and Boundary Cone Road. The site is accessed from State Highway 95 via east on Lipan Boulevard to the proposed subdivision, located on the south side of Lip an Boulevard, west of Bison Avenue. The property is vacant, relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist ofthe recorded portion of SUN VALLEY, Tract 4064-A, to the east; to the west is LOS LOGOS, Tract 4096-A; to the south is LOS LOGOS, Tract 4096-B; and to the north are SUN V ALLEY Tracts 4017 and 4018-8. There are no significant drainage patterns, and WHEREAS, SlJN V ALLEY, Tract 4064, was originally rezoned to R-1 (Single Family Residential) and R-O (Single Family ResidentiallMobile Homes Prohibited) via Resolution P&ZC No. 88-173 on December 5, 1988 and was amended by BOS Resolution No. 91-310 on December 2, 1991. The applicant requests this zone change to eliminate all the R-1 (Single Family Residential) zoned lots and to make all the lots within the unrecorded portions of SUN V ALLEY, Tract 4064, to be zoned R-O (Single Family ResidentiallMobile Homes Prohibited). The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2245C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. -,,, ,...,~" . . . . The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: 1. The following lots in SUN VALLEY, Tract 4064, will be rezoned R-O (Single Family ResidentialIMobile Homes Prohibited): Block 1 Block 13 Block 14 Block 15 Block 16 Block 17 Block 18 Block 19 Block 20 Block 21 Block 22 Block 23 Block 24 Block 25 Lots 25 thru 41 Lots 1 thru 12 Lots I thru 18 Lots I thru 18 Lots 1 thru 15 Lots 1 thru 14 Lots I thru 15 Lots 1 thru 8 Lots I thru 30 Lots I thru 18 Lots 1 thru 18 Lots I thru 22 Lots 1 thru 78 Lots I thru 3 2. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 3. The rezone will be effective upon the recordation of the Final Plat for each of the remaining phases of SUN V ALLEY, Tract 4064, or the rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 4. The lot size minimum will be based on the size of the lots recorded on the Final Plat, with no further lot splits. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 22, 1997, and posted on March 21, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ,.... NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 7, 1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
