HomeMy WebLinkAbout97-099 'NDEXED \ ~'r.ROFltMED l~~ ~ . . 9718192 BK 2882 PG 891 OFFICIAL RECORDS OF MOHAVE COUNTY, ( JOAN MC CALL, MOHAVE COUNTY RECORDEf 04/10/97 08:42A PAGE 1 OF 3 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-99 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR THE COMPLETION OF IMPROVEMENTS FOR DESERT LAKES GOLF COURSE AND ESTATES, TRACT 4076-C, BEING A SUBDMSION OF A PORTION OF SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST; AND FOR LOS LAGOS, TRACT 4096-A, BEING A SUBDIVISION OF A PORTION OF SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST; AND DESERT LAKES ESTATES, TRACT 4I52-A, BEING A SUBDIVISION OF PORTION OF SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7, 1997, a public hearing was conducted to determine whether an Extension of Time for the completion of improvements should be granted for the above described subdivisions as requested by Desert Lakes Development, L.P., of Fort Mohave, Arizona. The engineer of record is Raymond Stadler of Phoenix, Arizona, and WHEREAS, the subdivisions are located approximately one mile east of U.S. Highway 95 between Joy Lane and Boundary Cone Road. Desert Lakes Golf Course and Estates, Tract 4076-C, and Los Lagos, Tract 4096-A, can be accessed via U.S. Highway 95 east on Lipan Road approximately one mile. Desert Lakes Estates, Tract 4152-A, can be accessed via U.S. Highway 95, east on Joy Lane approximately one mile to the site, and WHEREAS, Desert Lakes Golf Course and Estates, Tract 4076-C, was recorded on May 5, 1990; Los Lagos, Tract 4096-A, was recorded on August 27, 1991; Desert Lakes Estates, Tract 4152-A, was recorded on November 28, 1995. The assurances for all three ofthe subdivisions are covered under the same agreement and financial account, and WHEREAS, during the span of the agreement there has been substantial progress on the improvements for Los Lagos and Desert Lakes Estates. The second "phase" of Los Lagos was completed and the third "phase" was substantially completed. Each phase is associated with a man-made lake. The County Engineer has authorized releases for both subdivisions throughout the year, Exhibit A being an accounting of those releases, and WHEREAS, evidence of substantial progress on the remaining improvements for Desert Lakes Golf Course and Estates, Tract 4076-C, has not been submitted and the County Engineer has not authorized any releases. Remaining items include street signs, placement of monuments, a wall and fencing, and . . . Substantial progress has been made toward the completion of the required improvements for Desert Lakes Estates, Tract 4152-A, and Los Lagos, Tract 4096-A. 2. Substantial progress has not been made toward the completion of the outstanding improvements for Desert Lakes Golf Course and Estates, Tract 4076-C. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 12, 1997, the Commission recommended APPROVAL for the Extension of Time for the Completion ofImprovements for Desert Lakes Golf Course and Estates, Tract 4076-C; Los Lagos, Tract 4096-A; and Desert Lakes Estates, Tract 4152-A, subject to the following: I. This Extension of Time for the Completion of Improvements will be in effect until December 20,1997. 2. The applicant continues to demonstrate substantial progress toward the completion of the improvements required in Los Lagos, Tract 4096-A, and Desert Lakes Estates, Tract 41 52-A. 3. The applicant completes all outstanding improvements for Desert Lakes Golf Course and Estates, Tract 4076-C. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 22, 1997, and posted on March 21, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 7,1997, APPROVED this Extension of Time for the Completion ofImprovements for Desert Lakes Golf Course and Estates, Tract 4076-C; Los Lagos, Tract 4096-A; and Desert Lakes Estates, Tract 4152-A, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
