RESOLUTION NO. 97-95
A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 94-325
AND 94-326 WHICH APPROVED THE REZONE AND THE SPECIFIC USE PERMIT FOR A
PORTION OF THE NW'I. NE'I. OF SECTION 8, SOUTH OF INTERSTATE 15, TOWNSHIP 40
NORTH, RANGE 15 WEST, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7,
1997, a public hearing was conducted to determine whether approval should be granted for the Rescission
of the Resolutions for the Rezone and the Specific Use Permit for the above described property as requested
by Michael Hart of St. George, Utah, and
WHEREAS, this property is located south ofInterstate 15 and west of the Interstate 15/Littlefield
Interchange. The site is accessed from Interstate IS via south at the Littlefield Interchange exit to Mohave
County Highway 91, then southwest on County Highway 91 approximately one-half mile to the site, located
on the north side between Interstate 15 and County Highway 91. The property is vacant, relatively flat,
sloping slightly to the southwest toward the Virgin River. The surrounding land uses consist of vacant land
and a few single-family residences. There is a school to the south. There are no significant drainage
patterns, and
WHEREAS, this property was conditionally approved for a rezone to CoMO (Commercial-
Manufacturing/Open Lot Storage) and M (General Manufacturing) by the Mohave County Board of
Supervisors on October 4,1994, via BOS Resolution No. 94-325. Also, a Specific Use Permit for the waste
water treatment plant in the M zoned area was approved at the same date with BOS Resolution No. 94-326
as requested by Danny Olson of St. George, Utah. The property has since been sold and Mr. Olson is no
longer involved in developing it. This property is now being developed by the applicant, Michael Hart, as
noted in his letter dated February 7, 1997, requesting that BOS Resolution Nos. 94-325 and 94-326 be
rescinded. The Mohave County General Plan designates this area as a Rural Development Area and an
Outlying Community, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site has legal access.
d. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 12, 1997, the Commission recommended that BOS Resolution Nos. 94-325 and 94-326 be rescinded.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 22, 1997, and posted on March 21, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 7, 1997, RESCINDED BOS Resolution Nos. 94-325 and 94-326 as recommended by
the Mohave County Planning and Zoning Commission and outlined herein.
