MOHAVE COUNTY RECORDEI 04/10/97 08:27A PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-93 A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF THE NWY- NEY- OF SECTION 8, L YING SOUTHERLY OF INTERSTATE 15, IN TOWNSHIP 40 NORTH, RANGE 15 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Michael Hart of St. George, Utah, and WHEREAS, this property is located south ofInterstate 15 and west of the Interstate 15/Littlefield Interchange. The site is accessed from Interstate 15 via south at the Littlefield Interchange exit to Mohave County Highway 91, then southwest on County Highway 91 approximately one-half mile to the site, located on the north side between Interstate 15 and County Highway 91. The property is vacant, relatively flat, sloping slightly to the southwest toward the Virgin River. The surrounding land uses consist of vacant land and a few single-family residences. There is a school to the south. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for developing a 145-space mobile home park. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. PAGE 2 OF 2 BK 2BB2 PG 881 FEE~9718187 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: I, This property will be rezoned C-2H (General Commercial Highway Frontage). 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.1 (Mobile Home Park Plan Requirements) must be completed and approved prior to approval of permits. In addition, a drainage report will have to be submitted. 3. Any other commercial endeavor will require a site plan be prepared and submitted in accordance with Section 27.P (Site Plan Requirements) and approved prior to approval of permits. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 6. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. 7. The owner/developer cannot sell any lots without the approval of the Mohave County Board of Supervisors. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 22,1997, and posted on March 21,1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
