A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 96-380,
SETTING FORTH A REZONE OF PARCEL 319, THE NEv.. SEv.. OF SECTION 20, TOWNSHIP
21 NORTH, RANGE 18 WEST, FROM A-R/I0A (AGRlCUL TURAL-RESIDENTIALffEN ACRE
MINIMUM LOT SIZE) ZONE TO A-R/I0A, A-R/5A AND A-R/2A (AGRlCULTURAL-
RESIDENTIALffEN ACRE, FIVE ACRE, AND TWO ACRE MINIMUM LOT SIZE) ZONES, IN
THE GOLDEN V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10,
1997, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 96-380,
setting forth a Rezone, should be granted for the above described property as requested by Marion Woods
of Ventura, California, and
WHEREAS, the language to be added has been bolded. Language to be deleted has been stmel<,
and
WHEREAS, this property is located south of State Highway 68 between Colorado Road and Verde
Road. The site is accessed from State Highway 68 via south on Verde Road to the site, located on the west
side between Diabase Drive and Newgard Drive. The property is vacant and relatively flat, sloping slightly
to the southeast. The surrounding land uses consist of vacant land and several single-family residences.
There are no significant drainage patterns, and
WHEREAS,the applicant requests this Amendment to BOS Resolution No. 96-380, approving
a Rezone, to change the orientation of the proposed lot splits to match the lot configuration as shown
on the Parcel Plat submitted by the applicant. The applicant requests this zone change to allow for
development of residential ranchettes. The applicant proposes to divide the 40-acre parcel into two 10-plus-
acre parcels, two 2-plus-acre parcels and one 5-plus-acre parcel. The Mohave County General Plan
designates this area as an Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 12, 1997, the Commission recommended APPROVAL for an Amendment to BOS Resolution No.
96-380, setting forth a Rezone, subject to the following:
I. These parcels will be rezoned A-Rll OA, A-Rl5A and A-Rl2A (Agricultural-Residentialffen
Acre, Five Acre and Two Acre Minimum Lot Size) as shown on Exhibit "A."
2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
3. The Board of Supervisors accepts the dedication of 42 feet of the existing roadway easement
known as Verde Road, 35 feet of existing roadway easement known as Diabase Drive, and
30 feet of existing easements known as Santa Maria Road and Newgard Drive, as roadway
rights-of-way. In addition, 20-foot radius curves are required at all dedicated roadway
intersection points.
4. The 8 feet adjacent to the right-of-way of the dedicated Verde Road, the 15 feet adjacent to
the right-of-way of the dedicated Diabase Drive, and the 20 feet adjacent to the right-of-way
of the dedicated Santa Maria Road and Newgard Drive, shall be granted to the public as a
Public Utilities Easement (PUE) and drainage easement.
5. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted
by the Board of Supervisors upon Parcel Plat recordation.
6. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
7. Each parcel shall have legal access.
8. The Parcel Plat shall show any surface drainage and FEMA flood zones.
9. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to any development. These permits will not be issued until Parcel Plat recordation.
10. The rezone shall not become effective until at least 30 days after final Board of Supervisors
approval for the change in classification, as per ARS 11-829E.

11. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County
Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not
recorded within one year of Board of Supervisor's approval, this rezone approval will be
void. All other conditions are to be met upon the development of the property. Before the
approval is declared void, the Board of Supervisors (after notification by registered mail to
the owner and the applicant who requested the rezoning) shall schedule a public hearing to
grant an extension, determine compliance with the schedule for development, or cause the
property to revert to its former zoning classification. This action is in accordance with
Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, February 22,1997, and posted February 21,1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, March 10, 1997, APPROVED this Amendment to BOS Resolution No. 96-380, setting forth
a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
