RESOLUTION NO. 97-61
A RESOLUTION SETTING FORTH AN ABANDONMENT OF A 25-FOOT ROAD RlGHT-OF-
WAY BETWEEN LOTS 2 AND 3, AND LOTS 6 AND 7, BLOCK 203, VIRGIN ACRES, TRACT
NO.1, IN THE NEv.. SWv.. OF SECTION 32, TOWNSHIP 41 NORTH, RANGE 15 WEST, IN THE
ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10,
1997, a public hearing was conducted to determine whether an Abandonment should be granted for the
above described roadway as requested by Edward and Charleen Bill of Syracuse, Utah, and
WHEREAS, the site is located west of County Highway 91 and north ofInterstate 15 in the Beaver
DamlLittlefield area. The site is accessed from Highway 91 via west on a local road known as "Old Pioneer
Road" to the southern edge of Section 32, Township 41 North, Range 15 West, then northwest on a 60-foot
Ingress & Egress (I&E) easement to the site. The site is to the southwest of the extension of this I&E. The
roadway is on the western cliff face of the Beaver Dam Wash and is surrounded by vacant land which slopes
eastward toward the wash, and
WHEREAS, this item was first presented to the Planning and Zoning Commission on January 8,
1997, where it was continued by an 8-0 vote. The applicant has discussed the roadway abandonment with
the Public Works and Planning and Zoning Departments' staff and has developed the appropriate mitigation
measures, as outlined in the Staff Recommendations, and
WHEREAS, the applicants request this Abandonment to allow for the construction of their new
residence. Mr. William Wall and Mr. Kim Merryhew, owners of lots adjacent to this roadway, are not
opposed to this abandonment. The Mohave County General Plan designates this area as a Rural
Development Area and an Outlying Community, and
WHEREAS, the Rio Virgin Telephone & Cablevision Co. states the roadway "cannot be
abandoned at this time until further information can be provided for servicing the lots behind the said
abandonment," and
WHEREAS, a review of FEMA FIRM Panel #040058-0025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:

a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
terrain.
d. The site has legal access.
e. The site lies on the western cliff face of the Beaver Dam Wash.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
February 12, 1997, the Commission recommended APPROVAL for an Abandonment subject to the
following:
I. A 25-foot Ingress and Egress (I&E) easement be granted along the western boundary of this
property to connect the existing 25-foot east-west running road rights-of-way.
2. The owner of Lots 2, 3, 4, 5,6, and 7, to be abandoned and reverted to acreage, will provide
a new 10-foot Public Utility Easement (PUE) to meet utility requirements of adjacent
properties denied utility access by this abandonment.
3. The roadway Abandonment will occur simultaneously with the Abandonment and Reversion
to Acreage of Lots 2,3,4,5,6 and 7.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, February 22, 1997, and March I, 1997, and posted
February 21,1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, March 10, 1997, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
