OF SECTION 33, LYING WESTERLY OF COUNTY HIGHWAY 91, TOWNSHIP 41 NORTH, RANGE 15 WEST, TO BE SUBDIVIDED AND KNOWN AS BEAVER DAM HEIGHTS, TRACT 3506, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO R-O (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED) AND M (GENERAL MANUFACTURING) ZONES, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on March 10, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by the owner/developer of Beaver Dam Heights, James A. Martin of Mesquite, Nevada, being represented by Mohave Engineering Associates, Inc., of Mesquite, Nevada, and WHEREAS, this property is located west of County Highway 91 and North of Interstate 15, approximately one and one-half miles north of the Interstate 15/Littlefield Interchange in the LittlefieldlBeaver Dam area. The site is accessed directly from County Highway 91 via west on Shirley Lane. The property is vacant, sloping slightly to the southeast. The southern portion slopes more to the south. The surrounding land uses consist of vacant BLM land to the north and east, a mobile home park to the west, and a few single-family residences to the southwest. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change for this property to be subdivided and known as BEAVER DAM HEIGHTS, Tract 3506. The applicant proposes to divide the 19.294 acres into 77 lots and four parcels. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. -. . . . PAGE 2 OF 2 BK 2869 PG 256 FEE~9712776 RESOLUTION NO. 97-59 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on February 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property will be rezoned R-O (Single Family ResidentiallMobile Homes Prohibited) with the exception of Parcels C and D, which will be rezoned M (General Manufacturing). This property will be subdivided and known as BEAVER DAM HEIGHTS, Tract 3506. The parcels zoned M (General Manufacturing) will require a Specific Use Permit for each use. 2. The appropriate zoning, building, environmental, and floodplain permits be obtained for all new construction. 3. The rezone will become effective upon recordation of the Final Plat for BEAVER DAM HEIGHTS, Tract 3506. If this development is phased, the zoning for the recorded phase only will become effective, or the rezone shall not become effective, until at least 30 days after fmal approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 4. The lot size minimum will be based on the size of the lots recorded on the Final Plat with no further lot splits. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, February 22, 1997, and posted February 21, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, March 10,1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
