OF SECTION 1, TOWNSmp 20 NORTH, RANGE 14 WEST, FROM A-R/36A (AGRICUL TURAL- RESIDENTIALrrmRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/IOA (AGRICULTURAL-RESIDENTIALrrEN ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on January 5, 1998, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by W, J, Roper of Kingman, Arizona, agent for Edward A and Karen M. Early of Rockville, Maryland, and WHEREAS, this property is located east of Kingman, south of Interstate 40, and west of U.S. Highway 93. The site is accessed from U.S. Highway 93 via west on Hidden Valley Road approximately one and one-half miles to the site, located on the south side of Hidden Valley Road. Hidden Valley Road is located approximately one-half mile south of the Interstate 40 and U.S. Highway 93 Interchange. The property is vacant and the terrain is rolling hills, sloping slightly toward the east. The surrounding land uses consist of vacant parcels and a few widely scattered single-family residences. There are no significant drainage patterns, and \. WHEREAS, the applicant requests this zone change to allow for development of rural residential ranch sites. The applicant proposes to divide the 38.46-acre parcel into two approximately 12-net-acre parcels and one approximately 10-net-acre parcel. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2375B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, a request for a rezone of this property to A-RJ5A (Agricultural-Residential/Five Acre Minimum Lot Size) was first considered by the Mohave County Board of Supervisors on January 2, 1996, and denied via BOS Resolution No. 96-28 "after receiving several letters in opposition from area landowners." After one year, the request was resubmitted and recommended for conditional approval by the Mohave County Planning and Zoning Commission on April 9, 1997. During their August 4, 1997 regular meeting, the Mohave County Board of Supervisors referred the matter back to the Planning and Zoning Commission. Following a meeting of area residents with Mohave County Planning and Zoning staff on September 17, 1997, at which a majority of residents requested a minimum 10-acre zoning for the area, the applicant submitted this request to rezone the subject parcel to A-RJIOA (Agricultural-Residential/Ten Acre Minimum Lot Size), and p RESOLUTION NO. 97-146 Page 2 . . F'AGE 2 OF 3 BK 3021 F'G 992 FEE~98003388 , WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on December 10, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These parcels will be rezoned A-R/l OA (Agricultural-ResidentiaVTen Acre Minimum Lot Size). 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. That a 42-foot road right-of-way along the north and west boundaries of the parcel shall be dedicated to the public and accepted by the Mohave County Board of Supervisors. In addition, 20-foot radius curves are required at all dedicated roadway intersection points. 4. The eight feet adjacent to all rights-of-way shall be granted to the public as a Public Utility Easement (PUE). 5. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted by the Board of Supervisors upon Parcel Plat recordation. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The applicable flood zone(s) shall be noted on the Parcel Plat. 9. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, December 20, 1997, and posted December 19, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
