MOHAVE COUNTY RECORDE! 05/12/97 04:25P PAGE 1 OF 2 MOHAVE COUNTY BOARO OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-142 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 2, BLOCK 1, SUNSET RANCHOS, TRACT 4046-C, IN SECTION 13, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A SALES OFFICE IN AN R-O (SINGLE FAMILY RESIDENTIAL/MOBILE HOMES PROHIBITED) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 5, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by A. B. Ramsey, Ramsey Home Development, of Fort Mohave, , Arizona, and ' WHEREAS, this property is located south of Bullhead City and east of State Highway 95 between Sterling Road and Camp Mohave Road. The site is accessed from State Highway 95 via east on Camp Mohave Road to Mountain View Road, then north on Mountain View Road to Sundance Drive, then east on Sundance Drive to Dixon Drive, then north on Dixon Drive to the site, located on the west side approximately 100 feet south of Sterling Road. The property has a single-family residence that is being used as a sales office and is relatively flat, sloping slightly to the west. The surrounding land uses consist of occupied single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a sales office in an R-O (Single Family ResidentiallMobile Homes Prohibited) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2435D indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, this action is to correct a violation of the Mohave County Zoning Regulations, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. ~ . . . PAGE 2 OF 2 BK 2899 PG 363 FEE~9724997 RESOLUTION NO. 97-142 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 9, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a sales office in an R-O (Single Family Residential/Mobile Homes Prohibited) zone and activities related thereto, including the selling of homes within SUNSET RANCHOS, Tract 4046-C, Subdivision. No off-site sales will be allowed. 2. The house will be fully functional and when it is no longer being used as a sales office, it will be reconfigured to a single-family residence. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. J 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or ifthe use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS. the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 19, 1997, and posted on April 18, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, May 5, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
