MOHAVE COUHTY RECOROEf 05/12/97 0,:2,P PAGE 1 OF 2 MOHAVE COUHTY BOARD OF SUPERVISORS RECORDIHG FEE 0.00 RESOLUTION NO. 97-141 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 1, BLOCK 7, LOS LAGOS, TRACT 4096-A, IN SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST, FOR A MODEL HOME IN AN SD/R (SPECIAL DEVELOPMENT/RESIDENTIAL) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 5, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above described property as requested by David Borges, David Borges Construction, of Bullhead City, Arizona, and -: WHEREAS, this property is located south of Bullhead City, east of State Highway 95 between Lipan Boulevard and Boundary Cone Road. The site is accessed from State Highway 95 via east on Lipan Boulevard to Mountain View Road, then south on Mountain View Road to Los Lagos Drive, then east on Los Lagos Drive to the site, located on the southeast comer of Los Lagos Drive and Lago Grande Drive. The property has a single-family residence under construction on it and is relatively flat, sloping slightly to the west. The surrounding land uses consist of single-family residences and vacant lots. Adjacent to the east is another model home. On the west side of Mountain View Road is Fort Mojave Indian Reservation land. To the north is the Los Lagos Club House. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a model home in an SD/R (Special Development! Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent ""ith the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, except the above noted Special Flood Hazard Area. -.. . . c _ RESOLUTION NO. 97-141 PAGE 2 OF 2 BK 2899 PG 361 FEE~972,996 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 9, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: I. This Zoning Use Permit is for a model home in an SD/R (Special Development/Residential) zone and activities related thereto, including the selling of homes within the LOS LAGOS, Tract 4096-A, subdivision. No off-site sales will be allowed. 2. The house will be fully functional and when it is no longer being used as a sales office and model home, it will be reconfigured to a single-family residence. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. i 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 19, 1997, and posted on April 18, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
