IND~l;.1J MICROfilMED 9724991 BK 2899 PG 3~8 OFFICIAL RECORDS OF MOHAVE COUNTY, i JOAN MC CALL, MOHAVE COUNTY RECORDEr 05/12/97 0~:23P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-136 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR DESERT LAKES GOLF COURSE AND ESTATES, UNIT F, TRACT 4132, BEING A SUBDIVISION OF A PORTION OF THE NWY< OF THE NEY< OF SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 5, 1997, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by Angel9 Rinaldi, president of Desert Lakes Development, Inc" for the above described Preliminary Subdi"ision Fran, The engineer of record is Stadler Consulting Engineers, Inc" Phoenix, Arizona, and WHEREAS, the subdivision is located approximately three miles south of Bullhead City, The site is accessed via State Highway 95, then east to the southwest corner of Joy Lane and Club House Drive, and WHEREAS, the Preliminary Plan depicts 8,7 acres subdivided into 38 single-family residential lots and two water well parcels, and WHEREAS, the developer has indicated in a letter dated February 28, 1997, that an Extension of Time is being requested due to the following: "At this time the subdivision improvements are essentially complete__,", and "As soon as the revisions to the Preliminary Plat are approved a Final Plat will be submitted along with certificates of construction and 'As-Built' plans", The developer has not indicated specifically which improvements have already been constructed within the subdivision, and WHEREAS, the Preliminary Plan was approved by the Mohave County Board of Supervisors on December 2,1991, per BOS Resolution No, 9]-331, The first and second Extensions of Time were granted on March 10,1995, per BOS Resolution No, 95-84, The third extension was approved on May 6,1996, per BOS Resolution No. 96-143. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, the developer has submitted a revised Preliminary Plan which is being taken before the Planning and Zoning Commission separately but concurrently with this extension request. The revisions proposed by the developer are significant enough to warrant consideration by the Commission and the Board of Supervisors, but are minor enough in nature that a new two-year period of Preliminary Plan approval is not warranted per the Subdivision Regulations. Accordingly, if this subdivision is not recorded in its . . PAGE 2 OF 2 BK 2899 PG 349 FEE~9724991 RESOLUTION NO. 97-136 Page 2 entirety within the next year, another Extension of Time of the conditions of BOS Resolution No. 91-331 (and subsequent amendments) will be necessary to continue processing the plat, and WHEREAS, this will be the fourth Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action complies with the Mohave COWlty General Plan, and the property is designated as an Urban Development Area. c. The site is adequate for the action intended and the proposal is consistent with the surroWlding land uses. d. This request complies with the Extension of Time Policy due to the following: A Final Plat of this subdivision was submitted for review. The Final Plat was rendered obsolete by a revised Preliminary Plan; however, the revised Preliminary Plan is currently actively processing. , , WHEREAS, at the public hearing before the Mohave COWlty Planning and Zoning Commission on April 9, 1997, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions ofBOS Resolution Nos. 91-331, 95-84, and 96-143. 2. Upon the receipt of any additional submittals for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surroWlding development will be reviewed and any required changes or modifications will be the responsibility of the developer. 3. This Extension of Time will be in effect Wltil December 2,1997. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 19, 1997, and posted on April 18, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
