A RESOLUTION SETTING FORTH A REZONE OF LOT 22, LAKE MOHA VE COMMERCIAL
CENTER, IN THE NEll. NEll. OF SECTION 2, TOWNSHIP 25 NORTH, RANGE 19 WEST, FROM
C-2 (GENERAL COMMERCIAL) ZONE TO CoMO (COMMERCIAL-MANUF ACTURING/OPEN
LOT STORAGE) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7,
1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above
described property as requested by Gary and Kelly Michaud, representing Gary's Service Center of Dolan
Springs, Arizona, and
WHEREAS, this property is located east of US Highway 93 and south of Pierce Ferry Road. The
site is accessed from US Highway via northeast on Pierce Ferry Road to the site, located on the south comer
of Pierce Ferry Road and Penny Street in the Outlying Community of Dolan Springs. There is an
automobile service center on the front of the property facing onto Pierce Ferry Road and a towing service
impound yard on the rear portion facing onto Penny Street. The terrain is relatively flat, sloping slightly to
the southwest. The surrounding land uses consist of other commercial businesses to the west and south, and
residences to the north and east. There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for a towing service and impound yard.
The Mohave County General Plan designates this area as a Rural Development Area and Dolan Springs is
an Outlying Community, and
WHEREAS, a review ofFEMA FIRM Panel #040058-1800C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, this action is to correct a violation of the Mohave County Zoning Regulations, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following:
I. Lot 22, LAKE MOHA VE COMMERCIAL CENTER, will be rezoned C-MO (Commercial-
Manufacturing/Open Lot Storage).
2. The applicant will provide a view-obscuring fence around the Open Lot Storage portion of
this property.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits. In addition, a Limited Drainage Report will have to be submitted
providing a method of mitigating anyon-site runoff created by this development, unless
waived by the Mohave County Engineer.
4. The Board of Supervisors accepts the dedication of the 20-foot radius curves at the
intersection of Pierce Ferry Road and Penny Street, and the intersection of Penny Street and
Don Well Drive. This may be accomplished by separate instrument prior to the approval of
this project.
5. Concurrence from the Mohave County Public Works Department will be required for the
location of any driveways. Any work performed in the public right-of-way will require a
Right-of- Way Use Permit from the Public Works Engineering Department, attention Bassam
Elters, P .E., Assistant County Engineer.
6. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
7. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.
8. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of geBeral
circulation in Kingman, Mohave County, Arizona, March 22, 1997, and posted on March 21, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 7, 1997, APPROVED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
