RESOLUTION NO. 97-117
A RESOLUTION SETTING FORTH A REZONE OF THAT PORTION OF PARCEL 349 LYING
EASTERLY OF US HIGHWAY 93, IN SECTION 6, TOWNSHIP 21 NORTH, RANGE 17 WEST
FROM A-R/I0A (AGRICUL TURAL-RESIDENTIALffEN ACRE MINIMUM LOT SIZE) ZONE
TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONT AGE) AND CoMO (COMMERCIAL-
MANUFACTURING/OPEN LOT STORAGE) ZONES, IN THE GOLDEN VALLEY AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7,
1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above
described property as requested by James M. Russell of Golden Valley, Arizona, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
WHEREAS, this property is located east of US Highway 93, approximately one mile north of the
State Highway 68 intersection. The site is accessed directly from US Highway 93. The property is vacant
with rolling hills rising from US Highway 93 toward the east. The surrounding land uses consist of vacant
land, several commercial enterprises to the west, a tavern and several single-family residences to the east.
There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for open lot sales and open lot storage.
The applicant proposes to rezone the northeast 250 feet by 250 feet (250' x 250') portion to C-MO
(Commercial-Manufacturing/Open Lot Storage) and the remainder of the property along US Highway 93
to C-2H (General Commercial Highway Frontage). The Mohave County General Plan designates this area
as a Rural Development Area, and
WHEREAS, this item was first heard at the Planning and Zoning Commission meeting on January
8, 1997, and was continued at the request of the Mohave County Public Works Department to resolve a
question regarding access, and
WHEREAS, a review of FEMA FIRM Panel #040058-2150B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following:
1. The northeast 250-foot by 250-foot (250' x 250') comer of this property will be rezoned C-
MO (Commercial-Manufacturing/Open Lot Storage) and the remainder of this property will
be rezoned C-2H/2A (General Commercial Highway Frontage/Two Acre Minimum Lot
Size) as shown on Exhibit "A."
2. The applicant will provide a view-obscuring fence around the C-MO (Commercial-
Manufacturing/Open Lot Storage) portion of this property.
3. The Board of Supervisors accepts the dedication of35 feet of the existing 50-foot easement
along the north boundary as road right-of-way. The remaining 15 feet shall be granted to the
public as a Public Utilities Easement and Drainage Easement (PUE and DE).
4. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits. In addition, a limited drainage report shall be submitted if any
significant impervious areas are created by this development.
5. The Arizona Department of Transportation (ADOT) should be contacted regarding access
to US Highway 93.
6. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
7. The rezone shall not become effective until at least 30 days afier final approval ofthe change
in classification by the Board of Supervisors, as per ARS 11-829E.
8. If these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title II, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 22, 1997, and posted on March 21, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 7, 1997, DENIED this Rezone based upon the following:
1. Incompatibility of surrounding land uses.
2. Opposition of surrounding property owners.
