WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7, 1997, a public hearing was conducted to determine whether approval should be granted to Rezone the above described property as requested by Jerry Lee and Diana 1. Portwood of Bullhead City, Arizona, and WHEREAS, this property is located south of State Highway 68 between Verde Road and Adobe Road. The site is accessed from State Highway 68 via south on Verde Road to the site, which is located on the east side of Verde Road approximately 1,750 feet south ofthe intersection of Verde Road and Redwall Drive. The property is occupied by two single-family residences. The terrain is relatively flat and slopes slightly to the south. The surrounding land uses consist of vacant parcels and widely scattered single-family residences. There are no significant drainage patterns, and WHEREAS, the applicants request this zone change to allow for residential development. The applicants propose to divide the 10,12-acre property into five approximately 1.5-acre parcels. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, the smallest lot size from minor land divisions in this section is 2.21 acres. Such divisions were authorized prior to the adoption of Resolution P&ZC No, 87-25, which rezoned the entire Golden Valley area, approved March 2, 1987, and the adoption of the Mohave County General Plan, approved March 10, 1995, and WHEREAS, the intent of Resolution P&ZC No, 87-25 was "to prevent unregulated parcel splitting and minimize the potential for the problems associated with these activities,", and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, this action is to correct a zoning violation of multiple residences on this property, and WHEREAS, the following described Findings of Fact are for the above captioned item: . . The proposed action and effect does not comply with the Mohave County General Plan or the Golden Valley/Sacramento Valley Area Plan. c. The site is adequate for the action intended but the use is not consistent with the surrounding land uses. d. The site has legal access. e. There are no significant environmental features affecting the site, except the Special Flood Hazard Area designation noted above. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 12, 1997, the Commission recommended APPROVAL for a Rezone subject to the following: I. These parcels will be rezoned A-R11.5A (Agricultural-Residential/One and one-half Acre Minimum Lot Size). Not more than five parcels will be created. 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is required. 3. Twenty-foot radius curves shall be granted at the intersection of the proposed 60-foot roadway easement and Verde Road. 4. All public easements granted on the Parcel Plat will be accepted by the Board of Supervisors upon Parcel Plat recordation. 5. The eight feet adjacent to all rights-of-way shall be granted to the public as a Public Utilities Easement (PUE) and drainage easement. 6. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 7. Each parcel shall have legal access. 8. The Parcel Plat shall show any surface drainage and FEMA flood zones. 9. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. 10. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS ll-829E. . . RESOLUTION NO. 97-114 Page 2 II. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and I02.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title II, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 22, 1997, and posted March 21, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 7,1997, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
