SWy. SEY. OF SECTION 2, TOWNSHIP 21 NORTH, RANGE 18 WEST, IN THE GOLDEN V ALLEY AREA, MORAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7, 1997, a public hearing was conducted to determine whether an Abandonment should be granted for the above described public utility easement as requested by Merrill Graham of Golden Valley, Arizona, and WHEREAS, the site is in Golden Valley, north of State Highway 68 and south of Earl Drive. Access to the site is from State Highway 68 via north on Houck Road to the site. The site extends northward approximately 660 feet from the intersection of Houck Road and Chino Drive, and WHEREAS, the applicant received a rezone for his property via BOS Resolution No. 95-189 on May I, 1995, allowing for his 5-acre property to be divided into four, I-plus-acre parcels. Condition number 3 of the Resolution asked the applicant to dedicate the 50-foot of the Houck Road easement on his property. This dedication reduces the applicant's net parcel size to 3.9 acres. The proposed abandonment will increase the parcel's net acreage and allow the applicant to divide his property as originally intended. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, Citizens Utilities Company and Valley Pioneer Water Company have reviewed the owner's petition and have no objection to the easement abandonment, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding area and terrain. d. The easement is currently unoccupied. e. The site has legal access. f. This is a level site. ( . . PAGE 2 OF 2 BK 2882 PG 919 FEE~9718204 RESOLUTION NO. 97-111 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on March 12, 1997, the Commission recommended APPROVAL for an Abandonment subject to the following: I. The applicant will grant the abandoned 20 feet of Roadway Easement as a Public Utility and Drainage Easement on the Parcel Plat required by BaS Resolution No. 95-189, amended. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, March 22,1997, and March 29,1997, and posted March 21, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, April 7, 1997, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
