A RESOLUTION SETTING FORTH AN EXTENSION OF TIME AND AMENDMENT TO BOS
RESOLUTION NO. 95-189 SETTING FORTH A REZONE OF THE EY. SEv.. SWv.. SEv.. OF
SECTION 2, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-RlI0A (AGRICULTURAL-
RESIDENTIALrrEN ACRE MINIMUM LOT SIZE) ZONE TO A-RlIA (AGRICULTURAL-
RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN V ALLEY AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7,
1997, a public hearing was conducted to determine whether an Extension of Time and Amendment to BaS
Resolution No. 95-189, setting forth a Rezone, should be granted for the above described property as
requested by Merrill Graham of Golden Valley, Arizona, and
WHEREAS, the language to be added has been bolded. Language to be deleted has been st!'tIek,
and
WHEREAS, this property is located north of State Highway 68 between Bacobi Road and Aztec
Road. The site is accessed from State Highway 68 via north on Houck Road to the site, which is located
on the northwest comer of Houck Road and Chino Drive. The property is occupied by a single-wide mobile
home, a double-wide mobile home, and a detached garage. The terrain is relatively flat and slopes slightly
to the southwest. The sUITOlll1ding land uses consist of vacant parcels and scattered single-family residences.
There are no significant drainage patterns, and
WHEREAS, the applicant requests this Extension of Time and Amendment to BOS Resolution No.
95-189, approving a Rezone, to allow for abandonment of roadway easements, dedication of road rights-of-
way, and granting of Public Utilities Easements and Drainage Easements necessary for the subject property
to comply with condition number 6 of BaS Resolution No. 95-189, and
WHEREAS, this will be the first Extension of Time for this property, and
WHEREAS, the Mohave County General Plan designates this area as an Urban Development Area,
and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and

WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 12, 1997, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject
to the following:
1. Continued compliance with the conditions of BOS Resolution No. 95-189, as amended
herein.
2. This Extension of Time will be in effect until May 1, 1998.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 12, 1997, the Commission recommended APPROVAL of the proposed Amendment to BOS
Resolution No. 95-189, setting forth a Rezone, subject to the following:
1. These parcels will be rezoned A-R11A (Agricultural-Residential/One Acre Minimum Lot
Size).
2. The submittal and recordation ofa parcel plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.

3. The remaining western 20-foot easement known as Houck Road be abandoned,
conditional to and upon the dedication of the east 30 feet and the south 30 feet of the
property to the public as road rights-of-way, complete with 20-foot radius curves at the
roadway intersections and a 20-foot PUE (public Utilities Easement) and DE (Drainage
Easement) granted adjacent to the 30-foot dedication.

4. 5., The grantings and dedications required by the rezone resolution shall be shown on the parcel
plat and accepted by the Board upon parcel plat recordation.
5. 6-: Each parcel shall meet or exceed its respective acreage exclusive of roadways.
6. 9-: Each parcel shall have legal access.
7. &: The parcel plat shall show any surface drainage and FEMA flood zones.
8.9-: That the appropriate zoning, building, environmental, and floodplain permits will be
obtained prior to any development. These permits will not be issued until parcel plat
recordation.
9. * The rezone shall not become effective for 30 days after final Board of Supervisors approval
for the change in classification, as per ARS ll-829E.
10. H-:- If the conditions stated above are not completed and approved within one year, then this
rezone shall become void as follows: the Board of Supervisors (after notification by
registered mail to the owner and applicant who requested the rezoning) shall schedule a
public hearing to grant an extension, determine compliance with the schedule for
development, or cause the property to revert to its former zoning classification. This action
is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 22, 1997, and posted March 21, 1997, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 7, 1997, APPROVED this Rezone as recommended by the Mohave County Planning and
Zoning Commission and outlined herein.
