A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF A
PORTION OF LOT 258, IN THE NEv.. OF SECTION 11, TOWNSHIP 21 NORTH, RANGE 19
WEST, FROM A-RlIA (AGRICULTURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE)
ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) AND M (GENERAL
MANUFACTURING) ZONES, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7,
1997, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be
granted for the above described property as requested by Robert Rester, representing the owner, Arlen
Kaygay, of Whittier, California, and
WHEREAS, this property is located south of State Highway 68 between Milky Way Road and
Estrella Road. The site is accessed from State Highway 68 directly to the site on the south side of the
highway. The property has a building being used as a garage on it. There are no significant drainage
patterns. The Mohave County General Plan designates this area as an Urban Development Area, and
WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors
on December 6, 1993, via BOS Resolution No. 93-361. It was not extended by the applicant due to an
oversight and not understanding the conditions of approval of the original BOS Resolution, and
WHEREAS, this Extension of Time will allow the applicant to complete the other conditions as
required by BOS Resolution No. 93-361. The required site plan was completed on February 10, 1997, and
WHEREAS, this will be the first Extension of Time for this property, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.

e. The site has legal access.
f. There are no significant environmental features affecting the site, except for the noted
Special Flood Hazard Area.
g. This request complies with the Extension of Time Policy as this was the first request, but
does not for the time interval between resolutions.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 12, 1997, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject
to the following:
1. Continued compliance with the conditions ofBOS Resolution No. 93-361.
2. This Extension of Time will be in effect until December 6,1997.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 22, 1997, and posted on March 21, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 7, 1997, APPROVED this Extension of Time for a Rezone as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.
