RESOLUTION NO. 97-106
A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE NORTHERLY 163 FEET OF
A 16-FOOT PUBLIC UTILITY EASEMENT BETWEEN LOTS 15 AND 16, BLOCK 7, SUNSET
RANCHOS, TRACT 4046-B, IN SECTION 13, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE
SOUTH MOHA VE V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, a1 the regular meeting of the Mohave County Board of Supervisors held on April 7,
1997, a public hearing was conducted to determine whether an Abandonment should be granted for the
above described public utility easement as requested by Nathan and Judy Beneze ofBu11head City, Arizona,
and
WHEREAS, the site is in South Mohave Valley, east of State Highway 95, and north of Camp
Mohave Road. Access to the site is from State Highway 95 via east on Camp Mohave Road to Mountain
View Road, then north on Mountain View Road approximately two-thirds of a mile to Sundance Drive, then
east on Sundance Drive approximately one-third of a mile to Beverly Drive, then north on Beverly Drive
to its intersection with Sterling Road. The site lies some 200 feet east of the intersection, perpendicular to
Sterling Road, dividing Lots 15 and 16, and
WHEREAS, the applicants own Lots 15 and 16 and request this Abandonment to allow for the
construction of a new pool and the extension of their landscaping onto Lot 16. The Mohave County General
Plan designates this area as a Low Density Residential, Urban Development Area, and
WHEREAS, Citizens Utilities Company, Mohave Electric Cooperative, and Bermuda Water
Company have reviewed the owner's petition and have no objection to the easement abandonment, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2435D indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
area and terrain.
d. The northerly 163 feet of the public utility easement is currently unoccupied.
e. The site has legal access.
f. The site slopes downward toward Sterling Road.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 12, 1997, the Commission recommended APPROVAL for an Abandonment, and
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 22,1997, and March 29,1997, and posted March
21, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 7, 1997, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
