A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON TRACT "A," WILLOW
VALLEY ESTATES, NUMBER 11, IN THE NWv.. SEv.. SEv.. SEv.. OF SECTION 27, TOWNSHIP
18 NORTH, RANGE 22 WEST, FOR A WATER TANK IN A C-2 (GENERAL COMMERCIAL)
ZONE, IN THE SOUTH MOHA VE V ALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 7,
1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by John Mihlik, President of the Willow Valley Water Company,
being represented by G. Kelly Grier of Burton Engineering, Inc., of Bullhead City, Arizona, and
WHEREAS, this property is located south of Bullhead City, west of State Highway 95 between
Willow Drive and King Street. The site is accessed from State Highway 95 via west on Commercial Street
to the site, located on the south side of Commercial Street at its T-intersection with Orange Avenue. The
property has a water well and a pressure tank on it and is relatively flat, sloping slightly to the west toward
the Colorado River. The surrounding land uses consist of commercial businesses to the east along State
Highway 95, an elementary school to the west, and a fire station to the south. There are scattered single-
family residences and vacant land to the north. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a 19-foot diameter water storage
tank. In addition, the water company plans to construct an office building and garage on this property, as
allowed in C-2 (General Commercial) zoning. The Mohave County General Plan designates this area as an
Urban Development Area, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2605C indicates the parcel described to be
in Zone B, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
March 12, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:
I. This Zoning Use Permit is for a 19-foot diameter water storage tank in a C-2 (General
Commercial) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
3. The water tank shall be painted an earth-tone color and will be fenced and landscaped
appropriately.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors, if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, March 22, 1997, and posted on March 21, 1997, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, April 7, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
