MlCROFllMED moEXm 9730385 BK 2912 PG 561 OFFICIAL RECORDS OF MOHAVE COUNTY, JOAN MC CALL, MOHAVE COUNTY RECORDE 06/09/97 02:55P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-197 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOTS 485 AND 486, LAKE MEAD CITY UNIT NO. 23 29 17, IN SECTION 23, TOWNSHIP 29 NORTH, RANGE 17 WEST, FOR AN ABOVEGROUND FUEL STORAGE TANK IN A C-2/1A (GENERAL COMMERCIAL/ ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE MEADVIEW PORTION OF MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 2, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Canyon Jetboat Services, L.L.C., being represented by Scott Seyler of Phoenix, Arizona, and WHEREAS, this property is located on the east side of Pierce Ferry Road, approximately eight and one-half miles south of Meadview Boulevard, between Donnie Road and Smith Road. The site is accessed directly from Pierce Ferry Road to the site on the east side of the road. The property is vacant and relatively flat, sloping slightly to the east. The surrounding land uses consist of Bureau of Land Management land to the west and vacant lots with several single-family residences and a cafe/market to the north. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for an aboveground fuel storage system for gasoline and diesel fuel to fuel jet boats. The Mohave County General Plan designates this area as a Rural Development Area and Meadview is considered an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-1475C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. . . . PAGE 2 OF 2 BK 2912 PG 562 FEE~9730385 RESOLUTION NO. 97-197 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 14, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for an aboveground fuel storage system to fuel jet boats and activities related thereto. 2. The appropriate State Marshal and local fire department regulations will be complied with to include any necessary permits required. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 17, 1997, and posted on May 16, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 2, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
