RESOLUTION NO. 97-193 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THAT PORTION OF LOT 101 LYING SOUTHEASTERLY OF PIERCE FERRY ROAD, GATEWAY ACRES, TRACT 10, IN SECTION 19, TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR A BULK PROPANE STORAGE TANK IN AN M-X (HEAVY MANUFACTURING) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 2, 1997, a public hearing was conducted to determine whether approval should be granted for a Zoning Use Permit for the above-described property as requested by Kelly Kite, District Manager for Ferrellgas, Inc., of Kingrnan, Arizona, and WHEREAS, this property is located east of US Highway 93 and south of Pierce Ferry Road. The site is accessed from US Highway 93 via northeast on Pierce Ferry Road to the site, located on the southwest corner of Pierce Ferry Road and Bee Drive, fronting on Pierce Ferry Road. The property is vacant and relatively flat, sloping slightly to the southwest. The surrounding land uses consist of a convenience store and mini-mart to the north, a real estate office to the south and several single-family residences to the east. The remaining property is vacant. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change and Zoning Use Permit to allow for a propane storage site for refilling delivery trucks. The Mohave County General Plan designates this area as a Rural Development Area and Dolan Springs, four miles to the northeast, is an Outlying Community, and WHEREAS, a review ofFEMA FIRM Panel #040058-1775B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 97-193 Page 2 . . WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 14, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: . 1. This Zoning Use Permit is for a 30,000-gallon propane storage tank for refilling delivery trucks and activities related thereto. 2. The applicant will comply with all the requirements of the State Fire Marshal's Office and the local fire department. 3. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 4. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 17, 1997, and posted on May 16, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 2, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
