MlCROALMED fNOEXEd 9730376 BK 2912 PG 542 OFFICIAL RECORDS OF MOHAVE COUNTY, ( JOAN MC CALL, MOHAVE COUNTY RECORDEr 06/09/97 02:52P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-188 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR PARADISE TRAILS, TRACT 3802, BEING A SUBDIVISION OF THE PORTION OF SECTION 25, TOWNSHIP 18 NORTH, RANGE 18 WEST, LYING WEST OF THE INTERSTATE 40 RIGHT-OF-WAY, IN THE YUCCA PORTION OF THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 2, 1997, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by the developer, Rubal Ruther of Double R Development, for the above-described Preliminary Subdivision Plan. The engineer of record is Todd Bremner of Lake Havasu City, Arizona, and WHEREAS, the subdivision is located approximately 17 miles south ofthe City of Kingman and two miles north of Yucca townsite. The site is accessed via the Old Trails Road interchange ofInterstate 40 and lies immediately west of the highway, and WHEREAS, the Preliminary Plan depicts 149 acres subdivided into 94 residential lots and 16 commercial lots. The residential lots range in size from one-half acre to one and one-half acres. The commercial lots range in size from one acre to slightly more than seven acres. The subdivision also includes a drainage parcel and a parcel for a well site, and WHEREAS, the developer has indicated in a letter dated March 31, 1997, that an Extension of Time is being requested due to the following: "The reason for this extension is to allow time for the marketability of the area to improve. The recent closing of the Kimberly-Clark paper plant has not helped the fragile public image the area has. In the meantime, we have already obtained extensions from the Arizona Corporation Commission and A.D.E.Q. for approval and construction of the water system.", and WHEREAS, the Preliminary Plan was approved by the Mohave County Board of Supervisors on May I, 1995, per BOS Resolution No. 95-193. Subdivision Regulations Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken, then all proceedings relating to the plat shall be terminated." No Final Plat of this subdivision has been submitted for review, and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed and has recommended that any required changes or modifications will be the responsibility of the developer, and RESOLUTION NO. 97-188 Page 2 .' " . . PAGE 2 OF 2 BK 2912 PG 543 FEE~9730376 WHEREAS, this will be the first Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request complies with the Extension of Time Policy due to the following: Normally a maximum of a one-year extension will be granted for adverse economic conditions, if the developer can demonstrate such hardship. The closing of the referenced paper plant could be considered an economic hardship for the Yucca area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 14, 1997, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions ofBOS Resolution No. 95-193. 2. This Extension of Time will be in effect until May 1, 1998. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 17, 1997, and posted on May 16, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, June 2,1997, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
