RESOLUTION NO. 97-187
A RESOLUTION SETTING FORTH AN ABANDONMENT OF THE REMAINING PORTIONS
OF A 60-FOOT ROAD AND UTILITY EASEMENT KNOWN AS MARANA ROAD BETWEEN
PARCELS 33 AND 34 AS SHOWN ON RECORD OF SURVEY PAGE 34, BOOK 1, IN THE SWv.
OF SECTION 9, TOWNSHIP 21 NORTH, RANGE 18 WEST, IN THE GOLDEN VALLEY AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 2,
1997, a public hearing was conducted to determine whether an Abandonment should be granted for the
above-described road and utility easement as requested by David L. Luce, representing La Questa, Ltd.,
Azusa, California, and
WHEREAS, Marana Road abuts State Highway 68 between Adobe and Verde Roads. Access to
the northern part of the road is directly off of Highway 68, while access to the southern part of the road is
from Shipp Drive. The road easement does not have signage, and
WHEREAS, the owner proposes the abandonment to enable a new Preliminary Plan for La Questa,
Ltd., to proceed. The central portion of Marana Road was abandoned by the same applicant in December
1994, via BOS Resolution No. 94-432, and
WHEREAS, Valley Pioneer Water Company and the Arizona Department of Transportation have
reviewed the owner's petition and have no objection to the easement abandonment. Citizens
Communications would prefer an eight-foot public utility easement (PUE) to be granted on both sides of
the common property line for Parcels 33 and 34 to fully serve these parcels. When Parcels 33 and 34 are
divided by the new plat, PUEs will be granted to serve all new lots and parcels, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2325D indicates the lots described to be in
Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surroundings
and terrain.
d. The easement is currently unoccupied.
e. The site has legal access.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 14, 1997, the Commission recommended APPROVAL for an Abandonment subject to the following:
1. The abandonment will become effective upon the recordation of the final plat for La Questa,
Ltd.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, May 17, 1997, and May 24,1997, and posted May 16,
1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, June 2, 1997, APPROVED this Abandonment as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
