A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN FOR SHIPP ESTATES III, TRACT 3026, BEING A
SUBDIVISION OF PARCELS 13 AND 14, AND THE Sir. OF THE Sir. OF PARCEL 15, AS SHOWN
ON RECORD OF SURVEY, BOOK 1, PAGE 35, IN SECTION 12, TOWNSHIP 21 NORTH,
RANGE 19 WEST, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 2,
1997, a public hearing was conducted to determine whether approval should be granted for an Extension of
Time as requested by Remington Chiang, Manager ofGV Development, Inc., owner of the property, for the
above-described Preliminary Subdivision Plan. The engineer of record for the project is Mohave
Engineering Associates, Inc., of Kingman, Arizona, and
WHEREAS, the subdivision is located approximately nine miles west of the City of Kingman and
is accessed via Highway 68, then south along and west of Teddy Roosevelt Road, and
WHEREAS, the Preliminary Plan depicts 90 acres subdivided into 280 single-family lots, and
WHEREAS, the manager for the project has indicated in a letter dated March 18, 1997, that an
Extension of Time is being requested based on the following: "The main reason for this request is the
economic condition at the moment. We are still pursuing Phases B and C of Shipp Estates III, Tract 3026,
and we have full intention of continuing with the project." The same request was received in 1996. No
documentation was submitted with the request that would demonstrate that the developer has been working
to advance the processing ofthis project. No Final Plats have ever been submitted for Phases B or C, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on May 7,1990, per BOS Resolution No. 90-119. An Extension of Time was requested and
fees were submitted on July 21, 1992. However, due to an oversight the extension was never processed.
The first and second Extensions of Time were granted on September 7, 1993, per BOS Resolution No. 93-
255. The third extension was granted on September 6,1994, per BOS Resolution No. 94-298. The fourth
extension was granted on August 7, 1995, per BOS Resolution No. 95-322. The fifth extension was
approved on June 3, 1996, per BOS Resolution No. 96-189. Subdivision Regulations Article 3.10-1 states:
"Upon application to the Commission and prior to the expiration of the time limit, extensions in increments
of one (I) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final
Plat. If such action is not taken, then all proceedings relating to the plat shall be terminated.", and
WHEREAS, the first phase of the project, Tract 3026-A, was recorded on October I, 1991, and

WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subaivision with surrounding development will be reviewed, and has recommended that any
required changes or modifications will be the responsibility of the developer, and
WHEREAS, the project engineer addressed the Planning and Zoning Commission at their meeting
on May 14, 1997, stating that the developer was now willing to submit a Final Plat for the next phase of this
subdivision for review. The Commission agreed to approve this Extension of Time if the developer
submitted the Final Plat for review within 90 days of the Commission meeting date (the approximate
deadline being August 14, 1997), and
WHEREAS, this will be the sixth Extension of Time, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. One condition of approval for last year's Extension of Time of this project was that unless
significant progress was made in the coming year toward the recordation of this project,
Planning staff would recommend denial of any additional Extensions of Time for the
Preliminary Plan. The Planning and Zoning Commission and the Board of Supervisors
approved this as a condition of the last extension. This condition has not been met.
c. This request does not comply with the Extension of Time Policy due to the following: (I)
No Final Plat has been submitted for review for Phase B; (2) a phase of this subdivision has
not been recorded in the two years prior to the expiration of the current Extension of Time;
and (3) no improvement plans have been approved within the last 12 months and the County
has received no indication from the developer that improvements are under construction.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
May 14, 1997, the Commission recommended APPROVAL of an Extension of Time for the Preliminary
Plan subject to the following conditions:
1. Compliance with all conditions ofBOS Resolution Nos. 90-119, 93-255, 94-298,95-322,
and 96-189.
2. A complete Final Plat submittal must be presented to the Planning and Zoning Department
within the next 90 days for the review of Phase B of this subdivision.
3. Unless significant progress is made in the coming year toward the recordation of this project,
Planning staff will recommend denial of any additional Extensions of Time for this
Preliminary Plan.
4. This Extension of Time will be in effect until April 2, 1998.

WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, May 17, 1997, and posted on May 16, 1997, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, June 2,1997, APPROVED this Extension of Time as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
