MOHAVE COUNTY RECORDEf 06/09/97 02:47P PAGE 1 OF 2 MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-175 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 174, MORAVE MESA, TRACT 1021, IN SECTION 27, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A SECONDARY RESIDENCE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MORAVE V ALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 2, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Joseph F. Tilley of Fort Mohave, Arizona, and WHEREAS, this property is located south of Bullhead City, west of State Highway 95 between EI Rodeo Road and Joy Lane. The site is accessed from State Highway 95 via west on Gardena Road to Downey Road, then south on Downey Road to the site, located on the west side approximately 225 feet south of Gardena Road. The property has a single-family residence on it and is relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of single-family residences and vacant lots. The Fort Mohave Indian Reservation is on the west side. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A-R (Agricultural-Residential) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 14, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 97-175 Page 2 . - . . PAGE 2 OF 2 BK 2912 PG 512 FEE~9730363 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondary residence may not be greater than one-half , the floor area of the primary residence. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. Section 27.R (Accessory or Secondary Residence Requirements) and a site plan in accordance with Section 27.R must be completed and approved prior to approval of permits. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 17, 1997, and posted on May 16, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
