'NDEXED - RESOLUTION NO. 97-167 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE WEST END OF THAT PORTION OF GOVERNMENT LOT 4 LYING BETWEEN INTERSTATE 15 AND OLD HIGHWAY 91, IN SECTION 32, TOWNSHIP 40 NORTH, RANGE 16 WEST, FOR AN OFF- PREMISE SIGN IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the special meeting of the Mohave County Board of Supervisors held on June 16, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Joseph V. Hamilton of Mesquite, Nevada, being represented by William J. Roper of Kingman, Arizona, and WHEREAS, this property is located between Interstate IS and County Highway 91 east of the Arizona/Nevada state line. The site is accessed from County Highway 91 directly to the north. The property is vacant; it is abandoned state right-of-way and slopes slightly to the south. The surrounding land uses consist of Interstate IS to the north, Nevada and the City of Mesquite to the west, vacant land to the east and the Fairview Mobile Homes Estates to the south. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for an off-premise sign in a C-2 (General Commercial) zone. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community. Interstate IS is designated a scenic route, as shown on Exhibit V.7, Scenic Routes and Vistas, page 54, Mohave County General Plan, and WHEREAS, Mohave County Zoning Regulations, Section 2l-B-5, Regulations for General Commercial or C-2 Zone, states that any parcel zoned C-2 fronting on or along a state highway that comply with the lot area requirements for C-2H zone, may have display uses permitted in the C-2H zone, and WHEREAS, a review ofFEMA FIRM Panel #040058-0200B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, Note: The Mohave County Board of Supervisors have not approved an off-premise sign since the implementation of the current General Plan, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect does not comply with the Mohave County General Plan. c. The neighboring area contains other like land uses similar to the above-proposed action. e. The s~te has legal access. f. There are no significant environmental features affecting the site. - WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on May 14, 1997, the Commission recommended DENIAL for a Zoning Use Permit based upon the following: 1. Interstate 15 is designated a scenic route, as shown on Exhibit V. 7, Scenic Routes and Vistas, page 54, Mohave County General Plan. 2. Scenic Resources Goals and Policies. Goal 9: To preserve, protect and enhance scenic routes and vistas that characterize the rural beauty of Mohave County. Policy 9.2: The County should preserve and enhance designated scenic routes that provide attractive natural and man-made vistas through the design and placement of roadways, private development and signage. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 17, 1997, and posted on May 16, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. WHEREAS, the Board of Supervisors at their meeting on June 2, 1997, received public comment in support of the signs and information that there were existing off-premise signs in the area. After receiving these comments, the Board continued this item to the June 16, 1996 meeting. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their special meeting on Monday, June 16, 1997, APPROVED this Zoning Use Permit subject to the following conditions: 1. This Zoning Use Permit is for one sign to be located any place on the property provided that the sign is a minimum of one thousand feet (I 000 feet) from any existing off-premise sign. 2.
