MOHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-165 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF THE NORTHERLY 176.53 FEET OF THE EASTERLY 325.79 FEET OF THE NWY4 NEY4 NEY4 OF SECTION 3, TOWNSHIP 40 NORTH, RANGE 15 WEST, FROM A-R (AGRICULTURAL- RESIDENTIAL) ZONE TO C-2 (GENERAL COMMERCIAL) ZONE, IN THE ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on June 2, 1997, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by Robert B. and Barbara J. Hallmark of Columbia, California, and WHEREAS, this property is located south ofInterstate IS and east of the Interstate 15/Littlefield interchange. The site is accessed from Interstate IS via south on Farm Road Exit 9 to the Interstate IS frontage road, then northeast on the frontage road to a roadway easement to the east along the north section line of Section 3, then east on this roadway easement approximately 300 feet to the site. The property is vacant and relatively flat, sloping slightly to the north. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area and an Outlying Community, and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on April I , 1996, via BOS Resolution No. 96-108, and WHEREAS, this Extension of Time will allow the applicant to complete the site plan, additional improvements, and the other conditions as required by BOS Resolution No. 96-108. The progress on this project was delayed due to health problems last year and the financial obligations that resulted from undergoing surgery, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. The site has legal access. e. There are no significant environmental features affecting the site. f. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zonhlg Commission on May 14, 1997, the Commission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Continued compliance with the conditions ofBOS Resolution No. 96-108. 2. This Extension of Time will be in effect until April 1, 1998. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, May 17, 1997, and posted on May 16, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOL YED, that the Board of Supervisors, at their regular meeting on Monday, June 2, 1997, APPROVED this Extension of Time for a Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
