RESOLUTION NO. 97-155
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 24, SUNHAVEN
HOMESITES, IN SECTION 33, TOWNSHIP 22 NORTH, RANGE 16 WEST, FORA RESIDENCE
IN A C-2/1A (GENERAL COMMERCIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE
KINGMAN AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 5,
1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above described property as requested by David and Cherish Sammeli of Kingman, Arizona, and

WHEREAS, this property is located northwest of State Highway 66, south of Northern Avenue, and
north of Diagonal Way, north of the City of Kingman. The site is accessed from State Highway 66 via
northwest on Diagonal Way to Able Drive, then northeast approximately 250 feet on Able Drive to the site,
located on the southeast side of Able Drive. The property has a single-family residence on it and is relatively
flat, sloping slightly to the southeast. The surrounding land uses consist of single-family residences, several
commercial businesses along State Highway 66, and vacant lots. There are no significant drainage patterns,
and
WHEREAS, the applicant requests this Zoning Use Permit for a residence in a C-2/lA (General
CommerciallOne Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area
as an Urban Development Area, and
WHEREAS, a review ofFEMA FlR1vl Panel #040058-21 65C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
April 9, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

1. This Zoning Use Permit is for a residence in a C-2/1A (General Commercial/One Acre
Minimum Lot Size) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property woJ,Lld be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, April 19, 1997, and posted on April 18, 1997, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, May 5, 1997, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
