SEv.. OF SECTION 5, LYING WESTERLY OF OATMAN HIGHWAY, IN SECTION 5, TOWNSHIP 20 NORTH, RANGE 17 WEST, FOR A STEEL FABRICATING PLANT IN AN M-X (HEAVY MANUFACTURING) ZONE, IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on May 5, 1997, a public hearing was conducted to determine whether a Specific Use Permit should be granted for the above described property 'ls requested by North Star Steel, being represented by Donald Van Brunt, Executive DirectoriJfMohave County Economic Development Authority, Inc., of Kingman, Arizona, and WHEREAS, the following described Findings of Fact are for the above captioned item: WHEREAS, this property is located southwest of the City of Kingman, west ofInterstate 40 and north of the McConnicolInterstate 40 Interchange. The site is accessed from Interstate 40 via northwest at the McConnico exit to Oatman Road, then northeast on Oatman Road to the site, located on the northwest side of Oatman RoadlFrontage Road approximately one-half mile northeast of the Oatman RoadlShinarwnp Drive intersection. The property is vacant and is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of a trucking company to the southwest, vacant land, a single-family residence, and several businesses. There is a significant drainage pattern crossing the property from the northeast to the southwest, and WHEREAS, the applicant requests this Specific Use Permit to allow for a steel fabricating plant for the bending and forming of construction rebar. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the northwest portion of this parcel described to be in Zone A, in the Special Flood Hazard Area; the remainder of the parcel described is in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the Mohave County Public Works Department requires that all right-of-way, roadway, drainage, and other infrastructural requirements will have to be commensurate with the type of development proposed, and a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. . . PAGE 2 OF 3 BK 2899 PG 386 FEE~9725006 RESOLUTION NO. 97-153 Page 2 d. The site has legal access. e. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on April 9, 1997, the Commission recommended APPROVAL for a Specific Use Permit subject to the following: 1. This Specific Use Permit is intended for a steel fabricating plant for the bending and forming of construction rebar and activities related thereto as shown on Exhibit "A"; any new use will require another Specific Use Permit. 2. The Specific Use Permit will commence upon the effective date of the rezone. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations'l Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. Approval of a Specific Use Permit with such conditions and restrictions as the Board of Supervisors may impose, shall be valid for two (2) years, in which time construction on the proj ect shall commence or the use authorized shall be initiated. Prior to expiration of the approval, the developer may request an Extension of Time from the Commission to initiate the project, and the Commission shall recommend to the Board an action based upon a finding of substantial grounds of which to grant such an Extension of Time up to one (I) year. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, April 19, 1997, and posted on April 18, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
