A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF WALNUT CREEK ESTATES, UNIT III, TRACT 3043,
BEING A SUBDIVISION OF A PORTION OF SECTION 7, TOWNSHIP 20 NORTH, RANGE 17
WEST, IN THE MCCONNICO PORTION OF THE MOHA VE COUNTY GENERAL AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 7,
1997, a public hearing was conducted to determine whether an Extension of Time should be granted as
requested by G, Kelly Grier of Burton Engineering, Inc., Bullhead City, Arizona, for the above-described
Preliminary Subdivision Plan. The owner/developer of the project is Dennis Sim for Walnut Creek
Development Co., Kingman, Arizona, and
WHEREAS, the subdivision is located approximately four miles southwest of the City of Kingman.
The property is accessed via Interstate 40, then southwest on Oatman Highway (Old Highway 66), then west
along McConnico Road to the site, and
WHEREAS, the Preliminary Plan depicts 211 acres subdivided into 160 single,family residential
lots, with a minimum lot size of one acre, and
WHEREAS, the first phase of this project, Tract 3043-A, was recorded on October 6,1994. Several
homes have been constructed within the first phase, and
WHEREAS, the representative for the engineer has indicated that an Extension of Time is being
requested in order to complete the processing of the remaining phases of the subdivision. The representative
also states in a letter dated April 29, 1997, "The Final Plat for Phase 'B' has been in review process with
your staff; however, completion of the process is still being held up pending resolution of the new water
source." No Final Plat has ever been submitted for Phase B of this subdivision, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on July 6,1992, per BOS Resolution No, 92-236. The first Extension of Time for the approved
Preliminary Plan was granted on July 5, 1994, per BOS Resolution No. 94-211. The second extension was
granted on September 5, 1995, per BOS Resolution No. 95-370. The third extension was approved on
August 5, 1996 per BOS Resolution No. 96-286. Subdivision Regulation Article 3.10-1 states: "Upon
application to the Commission and prior to the expiration of the time limit, extensions in increments of one
(I) year may be granted by the Board of Supervisors if the subdivider is actively processing the final Plat.
If such action is not taken then all proceedings relating to the plat shall be terminated," and

WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals ofthis project far processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will be reviewed, and has recommended that any
required changes or modifications will be the responsibility of the developer, and
WHEREAS, this will be the fourth Extension of Time, and
WHEREAS, the following are Findings of Fact for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. This request does not comply with the Extension of Time Policy due to the following: 1.
No Final Plat has been subrnitted for review for Phase B; 2. A phase of this subdivision has
not been recorded in the two years prior to the expiration of the current Extension of Time;
and 3. No improvement plans have been approved within the last 12 months and the County
has received no documentation to show that improvements are under construction.
WHEREAS, at the public hearing befare the Mohave County Planning and Zoning Commission on
June 11, 1997, the Commission recommended APPROVAL for an Extension of Time for the Preliminary
Plan subject to the following conditions:
I. Compliance with all conditions ofBOS Resolution Nos. 92-236, 94-21],95-370 and 96-286.
2. Unless significant progress is made in the coming year toward the recordation of this project,
Planning staff will recommend denial of any additional Extensions of Time for this
Preliminary Plan, and will recommend the rescission of the project.
3. This Extension of Time will be in effect until July 6, 1998.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, June 21, 1997, and posted June 20, 1997, as required by
Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, July 7,1997, APPROVED this Extension of Time for the Preliminary Plan as recommended
by the ~\lI\llWlhhnounty Planning and Zoning Commission and outlined herein.
