OF THE SWv. OF SECTION 14, TOWNSHIP 21 NORTH, RANGE 19 WEST,IN THE GOLDEN VALLEY AREA,MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 7, 1997, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by Al Haley, owner of the property, for the above-described Preliminary Subdivision Plan. The engineer of record for the project is Mohave Engineering Associates, Inc., of Kingman, Arizona, and WHEREAS, the subdivision is located approximately II miles west of the City of Kingman and is accessed via Highway 68, then south along Estrella Road, then east one-quarter mile along Redwall Drive to the site, and WHEREAS, the Preliminary Plan depicts 39 acres subdivided into 91 single-family residential lots and four parcels including the private roadway system, and WHEREAS, the owner of the project has indicated in letters dated April 28, 1997 and May 12, 1997, that an Extension of Time is being requested based on the assertion that a previous development partner has now been "bought out", clearing the way for the subdivision of this property, and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisars on October 7, 1991, per BOS Resolution No. 91,266. A Revised Preliminary Plan was approved on May 4, 1992, per BOS Resolution No. 92-148. The first Extension of Time was approved on June 6, 1994, per BOS Resolution No. 94,168, expiring on May 4, 1995. A second extension was requested by the owner in early 1995, without the required processing fee. Staff sent a letter dated April 26, 1995, to the owner indicating the need for the fees, No fees were submitted, and the request was accordingly not processed. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken, then all proceedings relating to the plat shall be terminated.", and RESOLUTION NO. 97-233 Page 2 . . PAGE 2 OF 3 BK 2929 PG 486 FEE~9737183 WHEREAS, due to the expiration of the approvals for this project and the lack of file activity staff sent a rescission notice to the owner dated February 12, 1997. The notice required that unless the owner contacted the County in writing within the following 90 days indicating an intent to actively process the subdivision plat, the subdivision would be scheduled for formal rescission. The owner was advised in the rescission notice that he had the option of requesting another Extension of Time for this subdivision and that such an extension was necessary to the renewed processing of the subdivision. However, the Preliminary Plan Extension of Time Policy would generally require staff to recommend denial of the request based on the lack of processing and the delinquency of the approvals for the project, and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed. They have recommended that any required changes or modifications will be the responsibility of the developer, and WHEREAS, staff had originally recommended the denial of this Extension of Time due in part to the request being received more than 90 days after the expiration of the last extension in 1995. The developer provided documentation showing that he had recently instructed his engineer to renew processing on this plat, and WHEREAS, this extension constitutes the second, third, and fourth Extensions of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The owner has submitted documentation showing that the project engineer has been instructed to proceed with the preparation of plats necessary for the continued processing of this subdivision. c. This request does not comply with the Extension of Time Policy due to the folloVving: 1. No Final Plat has ever been submitted for this subdivision; 2. No improvement plans have ever been submitted for this subdivision; 3. This request was received by the County two years after the expiration of the last extension ofthe approval for this project, well past the 90 days prescribed in the policy; and 4. Other than Extension of Time requests, there has been no processing activity for this subdivision in almost five years. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 11, 1997, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: I. Compliance with all conditions ofBOS Resolution Nos. 91,266 (as prescribed by 92-148), 92-148,92-193,92-259, and 94-168. . . PAGE 3 OF 3 BK 2929 PG 487 FEE:9737.183 3 Page RESOLUTION NO. 97-233 2. Unless significant progress is made in the coming year toward the recordation of this project, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan, and will recommend the rescission of the project. 3. This Extension of Time will be in effect until May 4, 1998. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 21,1997, and posted on June 20, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting on Monday, July 7, 1997, APPROVED this Extension of Time as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
