A RESOLUTION SETTING FORTH A SPECIFIC USE PERMIT ON A PORTION OF THE NWV.
SWv. OF SECTION 36, IN TOWNSHIP 16 NORTH, RANGE 21 WEST, FOR A LIQUID
NATURAL GAS STORAGE AND TRUCK LOADING FACILITY IN AN M-X (HEAVY
MANUFACTURING) ZONE, IN THE SOUTH MORAVE VALLEY AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 7,
1997, a public hearing was conducted to determine whether a Specific Use Permit should be granted for the
above-described property as requested by Applied LNG Technologies USA, LLC of Amarillo, Texas as a
sublessee ofEI Paso Fuel Development Company, EI Paso, Texas, and
WHEREAS, this property is located north of Interstate 40 between the Topock Interchange and the
Needle Mountain Interchange. The site is accessed from Interstate 40 via north at the Needle Mountain
interchange to a paved access road along the EI Paso Pipeline road/pipeline right-of-way across State of
Arizona land to the site. The property is vacant and the terrain is gently rolling hills that slope slightly to
the southwest toward the Colarado River. The surrounding land uses consist of vacant State of Arizona land
to the north, east, and south. The Havasu National Wildlife Area is to the west. There is an EI Paso Natural
Gas Company facility to the southwest, and the Mohave Pipeline Operating Company Compressor Station
and the EI Paso Fuel Development Company Plant site to the west. There are no significant drainage
patterns, and
WHEREAS, the applicant requests this Specific Use Permit to allow for a liquid natural gas storage
and truck loading facility in an M-X (Heavy Manufacturing) zone. The Mohave County General Plan
designates this area as a Rural Development Area. This property was rezoned to M-X (Heavy
Manufacturing) via BOS Resolution No. 96-83 on March 7, 1996, and
WHEREAS, a review ofFEMA FIRM Panel #040058-2815(; indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.

d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June 11, 1997, the Commission recommended APPROVAL for a Specific Use Permit subject to the
following:
I. This Specific Use Permit is intended for a liquid natural gas storage and truck loading facility
in an M-X (Heavy Manufacturing) zone and activities related thereto; any new use will
require another Specific Use Permit.
2. The applicant will comply with all the requirements ofthe State Fire Marshal's Office and
the local fire department.
3. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.P (Site Plan Requirements) must be completed and approved prior
to approval of permits.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. Approval of a Specific Use Permit with such conditions and restrictions as the Board of
Supervisars may impose, shall be valid for two (2) years, in which time construction on the
project shall commence or the use authorized shall be initiated. Prior to expiration of the
approval, the developer may request an Extension of Time from the Commission to initiate
the project, and the Commission shall recommend to the Board an action based upon a
finding of substantial grounds of which to grant such an Extension of Time up to one (I)
year.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, June 21, 1997, and posted on June 20, 1997, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
