RESOLUTION NO. 97-224
A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 90-113 AND
90-114, WHICH CONDITIONALLY APPROVED THE PRELIMINARY PLAN AND REZONING
FOR MOUNTAINSIDE RANCH, TRACT 4106, BEING A SUBDIVISION OF A PORTION OF
SECTION 6, TOWNSHIP 18 NORTH, RANGE 21 WEST, IN THE SOUTH MOHA VE VALLEY
AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 7,
1997, a public hearing was conducted to determine whether the approvals for the above-described project
should be rescinded. The owner of record for this property is Mohave Communities Limited Partnership,
Tempe, Arizona. The engineer ofrecord was Holland West, Inc., and
WHEREAS, the subdivision is located approximately five miles south of Bullhead City. The site
is accessed via State Highway 95, then east two miles along Boundary Cone Road to the property, and
WHEREAS, the Preliminary Plan depicts 206 acres subdivided into approximately 600 single-
family residential lots and 400 multi-family residential lots, and
WHEREAS, the Preliminary Plan was approved by the Mohave County Board of Supervisors on
May 7,1990, per BOS Resolution No. 90-113. The conditional rezoning of this property was approved on
the same day per BOS Resolution No. 90-114. A zoning use permit was approved for the use of a mobile
home as a sales office for this development per BOS Resolution No. 90-357. A Final Plat for Phase A of
this subdivision was approved per BOS Resolution No. 90-254. Final Plats for Phases Band C were
approved respectively by BOS Resolution Nos. 90-382 and 90-383. An Extension of Time for the ZUP was
approved per BOS Resolution No. 92-140. The first Extension of Time for the conditional approval of the
Preliminary Plan was approved per BOS Resolution No. 92-143. The second extension was approved per
BOS Resolution No. 93-154. The third extension was approved per BOS Resolution No. 94,202, expiring
May 5, 1995. All resolutions requiring compliance with the conditions ofBOS Resolution Nos. 90-113 and
90-114 will be voided with the rescission of the approvals for this project, and
WHEREAS, the Final Plat for Phase A was recarded on December 18, 1990. Following the
recardation of Phase A, the developer wished to have the recorded subdivision abandoned and reverted to
acreage, to make way for a new design. Recorded Phase A was abandoned and reverted to acreage per BOS
Resolution Nos. 92-252 and 92-253. The previous abandonment of this subdivision is not affected by this
rescission action, and

WHEREAS, advance notice was sent to the owner ofrecord on February 12, 1997, advising that
the project would be scheduled far rescission ifthe subdivision was not processed or otherwise brought into
compliance with the requirements of the Subdivision Regulations within 90 days. The property owner has
not responded, and
WHEREAS, all notices have been advertised and posted according to regulations, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June II, 1997, the Commission recommended APPROVAL of the rescission of this subdivision, and
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, June 21,1997, and posted on June 20, 1997, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting
on Monday, July 7,1997, APPROVED the rescission of this subdivision as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
