RESOLUTION NO. 97-223 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT ON LOT 133, LAGOON ESTATES, UNIT 2 (COMMERCIAL), IN SECTION 35, TOWNSHIP 18 NORTH, RANGE 22 WEST, FOR A MOBILE HOME AS A RESIDENCE IN A C-2 (GENERAL COMMERCIAL) ZONE, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 7, 1997, a public hearing was conducted to determine whether an Extension of Time for a Zoning Use Permit should be granted for the above-described property as requested by Helen 1. Brackett of Mohave Valley, Arizona, and WHEREAS, this property is located south of Bullhead City and east of State Highway 95 between Willow Drive and Laguna Road. The site is accessed from State Highway 95 via east on Vista Drive to Ash Street, then north on Ash Street to the property, located on the west side of Ash Street approximately 150 feet north of Vista Drive. The property is vacant and relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of single-family residences to the north, south, and east. There are neighborhood commercial businesses to the west. There are no significant drainage patterns. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of Supervisors on April 3, 1995 per BOS Resolution No. 95-134 and was extended the first time with BOS Resolution No. 96-232 on July I, 1996, and WHEREAS, the applicant requested in a letter dated April 14, 1997, that the Zoning Use Permit be extended for one year. This will be the second Extension of Time for this property, and WHEREAS, a review ofFEMA FIRM Panel #040058-2605C indicates the parcel described to be in Zone B, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. . . PAGE 2 OF 2 BK 2929 PG 466 FEE~9737173 RESOLUTION NO. 97-223 Page 2 d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County PI arming and Zoning Commission on June 11, 1997, the Commission recommended APPROVAL for an Extension of Time for a Zoning Use Permit subject to the following: I. Compliance with the conditions ofBOS Resolution No. 95-134. 2. This Extension of Time will be in effect until April 3, 1998. 3. This will be the last Extension of Time unless significant progress is made to complete the conditions ofBOS Resolution No. 95-134. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 21,1997, and posted on June 20, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, July 7,1997, APPROVED this Extension of Time for a Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
