MoHAVE COUNTY RECoRDE 07/14/97 03:36P PAGE 1 OF 2 MoHAVE COUNTY BOARD OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-221 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN FOR COURTNEY PARK EAST, TRACT 4147, BEING A SUBDIVISION OF A PORTION OF THE NWV. OF THE SWv. OF SECTION 23, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 7, 1997, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by G. Kelly Grier of Burton Engineering, Inc., Bullhead City, Arizona, for the above- described Preliminary Subdivision Plan. The owner of the project is Dennis Gootrad of Mohave Development, Inc., Westlake Village, California, and WHEREAS, the subdivision is located approximately one and one-half miles south of Bullhead City. The property is accessed via State Highway 95, then east on Aztec Road, then south along and east of Mesa Villas Drive, and WHEREAS, the Preliminary Plan depicts 7.12 acres subdivided into 34 multi-family residential lots, ranging in size from 7,000 to 12,025 square feet, and WHEREAS, the representative for the engineer has indicated in a letter dated May I, 1997, that an Extension of Time is being requested due to the following: "Phase A and B have been recorded. The final phase, Phase 'C', Final Plat is being prepared for submittal for review.", and WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on July 6, 1992, per BOS Resolution No. 92-232. The first Extension of Time for the approved Preliminary Plan was granted on September 6, 1994, per BOS Resolution No. 94-294. The second extension was granted on September 5,1995, per BOS Resolution No. 95-363. The third extension was approved on August 5, 1996, per BOS Resolution No. 96-278. The Final Plat for Phase A of this subdivision was conditionally approved by the Board of Supervisors on May 3,1993, per BOS Resolution No. 93-143. The Final Plat for Phase B of this subdivision was conditionally approved on February 18, 1997, per BOS Resolution No. 97-55. Subdivision Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (I) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, the Final Plat for Tract 4147-A was recorded on May 20,1993. The first phase of this project has been improved and a number of multi-family units have been constructed. The Board of . . . PAGE 2 OF 2 BK 2929 PG 462 FEE~9737171 RESOLUTION NO. 97-221 Page 2 Supervisors approved the As-Built Improvement Plans and released all remaining assurances for Tract 4147- A on June 3,1996, per BOS Resolution No. 96-182. The Final Plat for Tract 4147-B was recorded on March 12,1997, and WHEREAS, the Board of Supervisors approved an amendment to BOS Resolution No. 92-255 on December 4, 1995, per BOS Resolution No. 95-476. This amendment to the zoning resolution allowed certain open space recreation facilities to be constructed with the second phase of the development, and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development will be reviewed. They have recommended that any required changes or modifications will be the responsibility of the developer, and WHEREAS, this will be the fourth Extension of Time, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request complies with the Extension of Time Policy due to the following: This subdivision has been actively processed, with the most recent phase recorded in the past two years and improvement plans approved in the previous twelve months. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on June 11, 1997, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions ofBOS Resolution Nos. 92-232, 94-294, 95-363, and 96- 278. 2. This Extension of Time will be in effect until July 6, 1998. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, June 21,1997, and posted on June 20,1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
