RESOLUTION NO. 97-219
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF CAMP MOHA VE HEIGHTS, TRACT 4086, BEING A
SUBDIVISION OF A PORTION OF THE NEV. OF THE NEV. OF SECTION 23, TOWNSHIP 19
NORTH, RANGE 22 WEST, IN THE SOUTH MOHA VE VALLEY AREA, MOHA VE COUNTY,
ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 7,
1997, a public hearing was conducted to determine whether an Extension of Time should be granted as
requested by owner/developer Walter E. Stockman of WES Development Company, Newcastle, California,
for the above-described Preliminary Subdivision Plan. The engineer of record for the project is Burton
Engineering, Inc., of Bullhead City, Arizona, and
WHEREAS, the subdivision is located approximately one mile south of Bullhead City. The
property is accessed via State Highway 95, then east on Camp Mohave Road, then south along and east of
La Riqueza Road, and
WHEREAS, the Preliminary Plan depicts 20 acres subdivided into 79 single-family residential lots,
ranging in size from 7,785 to 11,394 square feet, and
WHEREAS, a representative for the project engineer has indicated in a letter dated April 28, 1997
that an Extension of Time is being requested due to the following: "The Phase 'B' Final Plat has been
approved with conditions. The Phase 'B' conditions are being addressed and utility contracts are being
finalized," and "Although Phase 'B' was approved for individual septic tanks, negotiations for sewer service
are progressing. As you know, final decisions on whether FMTUA or Sorenson will service this area should
be known within the next few weeks," and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on May 10, 1989, per P&ZC Resolution No. 89-88. The first Extension of Time for the
approved Preliminary Plan was granted on June I, 1992, per BOS Resolution No. 92-180. The second
extension was granted on May 3, 1993, per BOS Resolution No. 93-124. The third extension was granted
on November 3,1994, per BOS Resolution No. 94-383. The fourth extension was granted on August 7,
1995, per BOS Resolution No. 95-319. The fifth extension was approved on August 5, 1996, per BOS
Resolution No. 96-279. The Final Plat for the first phase of this development was conditionally approved
by the Board of Supervisors on February 5, 1990, per BOS Resolution No. 90-34. The Final Plat for the
second phase was conditionally approved on July 6, 1992, per BOS Resolution No. 92-246. Subdivision

Regulation Article 3.10-1 states: "Upon application to the Commission and prior to the expiration of the
time limit, extensions in increments of one (I) year may be granted by the Board of Supervisors if the
subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to
the plat shall be terminated," and
WHEREAS, the Final Plat for Tract 4086-A was recorded on May I, 1990. The first phase of this
project has been improved. A small number of homes have been constructed within Tract 4086-A, and
WHEREAS, a Final Plat for Phase B was submitted, reviewed and approved in 1992. After four
years of file inactivity the project engineer submitted a new Final Plat for Phase B in December, 1996. The
County awaits the submittal of a corrected Final Plat to address review comments resulting from the most
recent submittal, and
WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development will be reviewed, and has recommended that any
required changes or modifications will be the responsibility ofthe developer, and
WHEREAS, this will be the sixth Extension of Time, and
WHEREAS, the following are Findings of Fact for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. This request does not comply with the Extension of Time Policy due to the following: A
phase of this subdivision has not been recorded in the two years prior to the expiration ofthe
current Extension of Time.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June II, 1997, the Commission recommended APPROVAL for an Extension of Time for the Preliminary
Plan subject to the following conditions:
I. Compliance with all conditions ofP&ZC Resolution No. 89-88, and BOS Resolution Nos.
92-180,92-246,93-124,94-383,95-319, and 96-279.
2. Unless significant progress is made in the coming year toward the recordation of this project,
Planning staff will recommend denial of any additional Extensions of Time for this
Preliminary Plan, and will recommend the rescission of the project.
3. This Extension of Time will be in effect until June 1, 1998.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, June 21,1997, and posted June 20, 1997, as required by
Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, July 7, 1997, APPROVED this Extension of Time for the Preliminary Plan as recommended
by the Mohave County Planning and Zoning Commission and outlined herein.
