A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 95-268
SETTING FORTH A ZONING USE PERMIT ON LOTS 1, 2, 7, 8, 9, 10, 15 AND 16, AND
PORTIONS OF LOTS 17 AND 18, BLOCK 201, AND A PORTION OF LOT 20, BLOCK 200,
VIRGIN ACRES, TRACT NO.1, IN SECTION 32, TOWNSHIP 41 NORTH, RANGE 15 WEST,
FOR A MOBILE HOME PARK IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE
ARIZONA STRIP AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on July 7,
1997, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 95-268,
setting forth a Zoning Use Permit, should be granted for the above-described property as requested by
Beaver Birds, Inc., represented by Robert L. Miller of Richfield, Utah, and
WHEREAS, the language to be added has been bolded. Language to be deleted has been :ffltIek,
and
WHEREAS, this property is located west of U.S. Highway 91 and north of the Interstate 15 and
Highway 91 Interchange in the Littlefield area. The site is accessed from Highway 91 via west on a local
road known as "Old Pioneer Road" to the southern edge of Section 32, Township 41 North, Range 15 West,
then northwest on a IS-foot Ingress and Egress (I&E) easement to the site. The site is to the northwest of
the extension ofthis I&E, and
WHEREAS, the applicant is proposing to develop the property for a mobile home park. The
property is vacant and relatively flat. There are no significant drainage patterns. The surrounding land uses
consist of the Virgin Village No. I and 2 subdivisions to the northeast. The property to the north, south and
west is part of the Virgin Acres, Tract No. I, subdivision and is vacant, and
WHEREAS, the applicants request this Amendment to BOS Resolution No. 95-268, approving
a Zoning Use Permit, to amend condition number 2 which requires a 60-foot road right-of-way to the
referenced property. Mr. Miller is requesting the road right-of-way be reduced to 50 feet for the
approximate 225 feet of roadway adjacent to the Beaver Birds, Inc., property. The existing roadway
known as "Old Pioneer Road" follows a 25-mph curve. However, a 60-foot right-of-way would require
the property owner to the south, Mr. Jay Pratt, to dedicate more property than he is willing to. He
has installed an expensive fence and extensive landscaping inside the fence. Mr. Pratt is willing to
dedicate his property where the existing "Old Pioneer Road" is located, as well as property to the
north, but he is not willing to dedicate any property on the south side of the existing roadway. A 50-
foot road right-of-way and a 25-mph curve would follow the existing "Old Pioneer Road" roadway,

WHEREAS, the Mohave County General Plan designates this area as a Rural Development Area
and an Outlying Community, and
WHEREAS, a review ofFEMA FIRM Panel #040058-0025B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and

inaaequate 1'6tential [51 aeee33 1'6 thi3 Mea. If the developer wishes to provide adequate access to this
property, the department suggests that sufficient right-of-way be provided along the alignment known as
"Old Pioneer Road" as a collector route, to extend from Route 91 to the subject property. Public Works
records indicate that there exists a 60-foot right-of-way along a portion of this alignment. Because of this
eXIsting condition, the Public Works Department would support the granting of a variance to lessen the
Mohave County Standard Collector Route right-of-way requirements from 70 feet to 60 feet for this route.
In addition, we recommend that as a minimum the roadway would have to be constructed in accordance with
Standard Specification No. 161 and Standard Detail No. 61, as amended by BOS Resolution No. 91-335,
and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
June II, 1997, the Commission recommended APPROVAL for an Amendment to BOS Resolution No. 95-
268 setting forth a Zoning Use Permit subject to the following:
I. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. Section 27.1 (General Provisions, Mobile Home Parks) and Section 27.P (Site
Plan Requirements) must be completed and approved prior to approval of permits.
2. The applicant will provide a 60-foot roadway right-of-way to be constructed in accordance
with Standard Specification No. 161 and Standard Detail No. 61, as amended by BOS
Resolution No. 91-335, except for that portion of the roadway from the eastern section
line of Section 32 to the western property line of the Beaver Birds Mobile Home Park,
which will be a 50-foot roadway right-of-way to allow for a 25-mph curve as shown on
Exhibit "A."
3. The appropriate zoning building, environmental, and floodplain permits will be obtained.

4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, June 21,1997, and posted on June 20, 1997, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, July 7, 1997, APPROVED this Amendment to BOS Resolution No. 95-268, setting forth a
Zoning Use Permit, as recommended by the Mohave County Planning and Zoning Commission and outlined
herein.
