WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 2, 1997, a public hearing was conducted to determine whether an Abandonment should be granted for the above-described easements as requested by the owner, Charter Standard Bank of England, represented by William T. Miller, William T. Miller Engineers, Inc., Lake Havasu City, Arizona, and WHEREAS, the site is west of London Bridge Road (Old Highway 95) and north of Chenoweth Drive. The entrance to the site, North View Drive, currently fenced, is approximately one mile north of the Chenoweth/London Bridge Road intersection. The easements occur along the rear of the above-described lots, and . WHEREAS, the site is part of Havasu Garden Estates East, Tract 1122, an 834-lot subdivision recorded in 1972. The ovmer proposes to abandon the easements and abandon and revert to acreage 150 lots to allow for a new recreational vehicle park and general commercial center. All easements and lots are currently unoccupied; however, the privately owned roads have been graveled. The site slopes southwest toward the Colorado River. The General Plan specifies this site for urban development, and WHEREAS, Citizens Utilities Company has reviewed the owner's petition and has no objection to the easement abandonment, and WHEREAS, Cable Vision of Lake Havasu has reviewed the owner's petition and will approve the abandonments after the plans have been reviewed, and the county has approved a recreational vehicle park plan for this site, and WHEREAS, the Department of Public Works does not object to the abandonment and/or the reversion to acreage, and WHEREAS, a review of FEMA FIRM Panel #040058-2970B indicates the easements described to be in Zone AO-2 Foot, in the FEMA Special Flood Hazard Area, and . ~," ~ ~ . - . All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surroundings and terrain. d. The site has legal access. e. The site is bounded by a sizable dry wash to the south and a hill to the north. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 13, 1997, the Commission recommended APPROVAL for the Abandonment subject to the following: 1. The owner will submit Recreational Vehicle Park plans to Mohave County for review and approval, in accordance with Section 27.1 of the Mohave County Zoning Ordinance, prior to the abandonment of these easements. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 16, 1997 and August 23, 1997, and posted August 15, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 2, 1997, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
