WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 4, 1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by F. Roy and Scott Dunton of Kingman, Arizona, and WHEREAS, this property is located north of Interstate 40 and west of the Blake Ranch Road Interchange. The site is accessed from Interstate 40 via north on Blake Ranch Road to Snobird Way, then west on Snobird Way to Ty Road, then south on Ty Road to Yeater Drive, then west on Yeater to the site, located approximately 1,880 feet west of the intersection of Yeater Drive and Ty Road. The property is vacant and slopes slightly to the west. The surrounding land uses consist of vacant land to the north and west, and Interstate 40 to the south. There is a truck stop with associated buildings to the east. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for an off.premise sign in a C-2H18A (General Commercial Highway FrontagelEight Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2375B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and , WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. There are several on-premise signs to the east of this property. e. The site has legal access. f. There are no significant environmental features affecting the site, except for the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 9, 1997, the Commission recommended DENIAL for a Zoning Use Permit based upon the following: ... . . . Interstate 40 is designated a Scenic Route, as shown on Exhibit V.7, Scenic Routes and Vistas, page 54, Mohave County General Plan. 2. Scenic Resources Goals and Policies. Goal 9: To preserve, protect and enhance scenic routes and vistas that characterize the rural beauty of Mohave County. Policy 9.2: The County should preserve and enhance designated scenic routes that provide attractive natural and man-made vistas through the design and placement of roadways, private development and signage. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 19, 1997, and posted on July 18, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 4, 1997, APPROVED this Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for an off-premise sign on a portion of Parcel 13, CEDAR HILLS RANCHES, Amended, and activities related thereto. 2. The applicant shall obtain the proper Arizona Department of Transportation (ADOT) permits and approval prior to erecting this sign and meet the proper ADOT spacing and distance requirements. 3. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6.
