RESOLUTION NO. 97-284
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE WYZ WYZ
OF SECTION 8, LYING BETWEEN THE SOUTHERLY RIGHT-OF-WAY LINE OF STATE
HIGHWAY 66 AND THE NORTHERLY RIGHT-OF -WAY LINE OF THE BN&SF RAILROAD,
IN TOWNSHIP 20 NORTH, RANGE 17 WEST, FOR A RESIDENCE IN AN M12A (GENERAL
MANUF ACTURINGfTWO ACRE MINIMUM LOT SIZE) ZONE IN THE MOHA VE COUNTY
GENERAL AREA, MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 4,
1997, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the
above-described property as requested by Darryl and Nancy Smith of Kingman, Arizona, and
WHEREAS, this property is located southeast of the Interstate 40/McConnico Interchange between
State Highway 66 and the BN&SF Railroad, southwest of the City of Kingman. The site is accessed from
Interstate 40 via the McConnico Interchange, then east to the Frontage Road, then southwest on the Frontage
Road to the site. The property has a salvage, scrap, and dismantling yard on it and is relatively flat. The
surrounding land uses consist of vacant land, North Star Steel, several trucking related businesses, and
another salvage yard. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a residence in an M/2A (General
Manufacturing/Two Acre Minimum Lot Size) zone. The Mohave County General Plan designates this area
as an Urban Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
July 9, 1997, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following:
1. This Zoning Use Permit is for a residence in an M/2A (General Manufacturing/Two Acre
Minimum Lot Size) zone and activities related thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, July 19, 1997, and posted on July 18, 1997, as required
by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, August 4,1997, APPROVED this Zoning Use Permit as recommended by the Mohave County
Planning and Zoning Commission and outlined herein.
