( JOAN MC CAll, MOHAVE COUNTY RECORDE! 08/06/97 03:56P PAGE 1 OF 2 MOHAVE COUNTY BOARO OF SUPERVISORS RECORDING FEE 0.00 RESOLUTION NO. 97-275 A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 96-345 SETTING FORTH A REZONE OF PARCEL 46, AS SHOWN ON RECORD OF SURVEY, BOOK 1, PAGES 27 AND 43, IN SECTION 10, TOWNSHIP 21 NORTH, RANGE 18 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) AND CoMO (COMMERCIAL-MANUF ACTURING/OPEN LOT STORAGE) ZONE, IN THE GOLDEN VALLEY AREA, MOHA VE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 4, 1997, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 96-345, setting forth a Rezone, should be granted for the above-described property as requested by Burro, L TD, a Nevada corporation, being represented by Jim Kuden of Escondido, California, and WHEREAS, the language to be added has been bolded. Language to be deleted has been stI'tIek, and WHEREAS, this property is located on the south side of State Highway 68 between Aztec Road and Adobe Road. The site is accessed from Highway 68 via south on Aztec Road approximately 400 feet to the site, which is located on the southwest corner of Highway 68 and Aztec Road. The property is relatively flat, sloping slightly to the southwest. Presently there is a swap meet and mini-storage on the property. The surrounding land uses consist of vacant land to the south, east and west. There are several commercial businesses on the north side of Highway 68. There is a significant drainage pattern that crosses the property from north to south through the west side of the property, and WHEREAS, the applicants request this Amendment to BOS Resolution No. 96-345, approving a Rezone, to delete Condition of Approval Number 8, requiring Aztec Road to be paved adjacent to this property, and "'HEREAS, the Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review ofFEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. . . . . PAGE 2 OF 2 BK 2941 PG 596 FEE~9741974 RESOLUTION NO. 97-275 Page 2 c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site, other than the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 9, 1997, the Commission recommended DENIAL for the proposed Amendmentto BOS Resolution No. 96-345, setting forth a Rezone of Parcel 46, based upon the following: 1. The amount of additional traffic that will be generated by this project is estimated to exceed 200 trips per day on the weekend and, therefore, justifies the requirement that the access road be paved. In addition, the amount of dust that will be created by the expected increase in traffic would be a burden to the adjacent residents and would decrease the air quality of this area. Also, the Mohave County Public Works Department is concerned that the dust created by this additional traffic could cause a visibility hazard for the traffic on State Highway 68. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 19,1997, and posted on July 18,1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 4, 1997, DENIED this Amendment to BOS Resolution No. 96-345, setting forth a Rezone of Parcel 46, as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
