WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 4, 1997, a public hearing was conducted to determine whether an Extension of Time should be granted as requested by G. Kelly Grier, representative of Burton Engineering, Inc., for the acceptance of the As-Built Improvement Plans for the completion of improvements within the above described subdivision. The owner is McKellips Land Corporation of Phoenix, Arizona, and WHEREAS, the subdivision is located approximately eight miles south of Bullhead City. The site is accessed via State Highway 95, then west almost two miles along and north of King Street, and WHEREAS, the representative for the engineer indicated in a letter dated December 2, 1996, that an Extension of Time is being requested based on the following: "...The Willow Valley Water Company is experiencing a scheduling problem with the contractor. The water tank is to be moved on December 16, and cannot be scheduled any sooner. The work is anticipated to be completed between the 18th and the 20th of December. This means that the condition of the approval ofBOS Resolution No. 96-105, that the work to be completed by December 15th [sic], will not be met." Another extension was obtained, expiring April 17, 1997. The work was not completed by that date and this latest extension has been requested, and WHEREAS, the Final Plat for Willow Valley Estates, Unit 20, Tract 4134-A, was recorded on August 16, 1996. The Board of Supervisors conditionally accepted the As-Builts for this phase of the subdivision on June 17, 1996, per BOS Resolution No. 96-105. The conditions of that resolution have not been met, and WHEREAS, the Public Works Department has stated that continued compliance with BOS Resolution No. 96-105 is required, and WHEREAS, the following are Findings of Fact for the above captioned item: a. Most of the improvements have been completed within this subdivision, including the relocation of the water tank. As-Built Improvement Plans have not been received to demonstrate the extent of the work performed for the tank relocation. Work toward obtaining the necessary fire department and ADEQ approvals for the relocation of the water tank in this subdivision appears to still be in progress. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 9, 1997, the Commission recommended APPROVAL of the Extension of Time for the approval of the As-Built Improvement Plans for the completion of improvements in this subdivision, subject to the following conditions: 1. Compliance with all of the conditions of BOS Resolution No. 96-105, except condition number I G (condition 1 G stipulated that the initial approval of the As-Builts for the relocation of the water tank expired after 180 days, in mid December, 1996.) 2. Compliance with all of the conditions ofBOS Resolution Nos. 96-341 and 97-35, except those conditions which specify dates of expiration of the extension approvals which have already come and gone. 3. This Extension of Time will be in effect until October 17, 1997. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, July 19, 1997, and posted on July 18, 1997, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 4, 1997, APPROVED this Extension of Time of the approval of the As-Built Improvement Plans for the completion of improvements in Willow Valley Estates, Unit 20, Tract 4134-A, as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ,,\\\\\\\\H1m!!li!''l!^ ,\\\\\ o\j'1 S r '~'I!,'.'... #-' 1(. f\ U f!
